BACKGROUND

 

The subject property, 967-969 St. Laurent Boulevard, is located on the east side of St. Laurent Boulevard and near the northeast corner of Donald Street and St. Laurent Boulevard.  The site is presently occupied by a two-storey vacant building known municipally as 967 St. Laurent Boulevard.  The total area of the property is 455.0 square metres.  A paved driveway exists on the south side of the building leading to several parking spaces available on the east side of the building at the rear.  Surrounding uses comprise of commercial uses along the east side of St. Laurent Boulevard and the rear of subject property.  A mix of commercial and residential uses exists along the west side of St. Laurent Boulevard across the street from the subject property.

 

A two-storey, legal non-conforming two-unit residential building known municipally as 969 St. Laurent Boulevard was demolished on April 7, 2008 without permission from the City.  The owner has provided a supporting document titled “Structural Integrity Assessment” (see Document 2).  The purpose of the Demolition Control Application is to seek approval from the City as to not require a replacement building.  In this regard, the owner proposes to use the vacant site as parking for a medical office to be established within the building remaining on site at 967 St. Laurent Boulevard.

 

Under the Demolition Control By-law, City Council approval of a demolition permit is required within the former City of Ottawa when a residential use building is proposed to be removed from a property without a replacement building.  Extenuating circumstances, led to the building being demolished without the appropriate Demolition Control approval or a Demolition Permit.  To ensure compliance with the Demolition Control By-law, the owner has submitted this application to formally obtain Council approval for the demolition that has taken place, as the owner does not intend to replace the former building.  A Building Permit application has been submitted by the applicant for the proposed retrofitting of the existing building (967 St. Laurent Boulevard) for medical office use and, its final consideration is pending the approval of this Demolition Control application.  The property is zoned AM (Arterial Mainstreet) which permits medical use.

 

DISCUSSION

 

Staff is recommending approval of this application.  The removal of the building was required since the structural integrity (see Document 2) of the abandoned building (969 St. Laurent Boulevard) constituted a fire and structural hazard. 

 

The Planning Act and the Demolition Control By-law enable Council to impose conditions on demolition control approvals.  In this circumstance, conditions are not recommended as the residential use building was legal non-conforming and the applicant has submitted a Building Permit application for the proposed retrofitting of the existing building (967 St. Laurent Boulevard) for medical office use, which is permitted within the Arterial Mainstreet zone.  A change of use of the existing building to medical office use does not require Site Plan Control approval, but will need approval from the Planning and Growth Management Department for the grading and drainage of any new paved parking and driveway areas that are proposed where the building that was demolished was located.

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy.  The Ward Councillor is aware of this application and the staff recommendation.
