That Council approve the following recommendations:

 

1.                  That conditional grants of an estimated $100,000 in lieu of building permit fees, an estimated $68,000.00 for cash in lieu of school board fees, and an estimated $20,000 to fund miscellaneous planning fees that cannot be waived for Action Ottawa projects, subject to the said grants being included in a Municipal Housing Project Facilities and Contribution Agreement between the City and the Incorporated Synod of the Diocese of Ottawa respecting the Cornerstone Supportive Housing Residence for Women at 314 Booth Street that provides for forty-two rental affordable housing units for low-income seniors and persons with disabilities and provides for funding in the amount of $6,300,000 under the Canada-Ontario Affordable Housing Program Extension (2009).

 

2.      That the recommendation in Action Ottawa – Canada Ontario Affordable Housing Program Extension (2009): Cornerstone Supportive Housing Residence For Women report (ACS2009-COS-CAS-0021) be amended by replacing “the Incorporated Synod of the Diocese of Ottawa” with “the proponent approved by the Ministry of Municipal Affairs and Housing, being either The Incorporated Synod of the Diocese of Ottawa or Cornerstone Housing For Women Foundation”.

BACKGROUND

 

On June 9, 2009, the Federal and Provincial Governments signed agreements resulting in an extension to the Canada-Ontario Affordable Housing Program (AHP) that consisted of $540 million in funding available over 2009/2010 for the creation of new affordable housing units with dedicated funding for low-income seniors ($307.76 million) and persons with disabilities ($57.7 million). Council approved two Quick Start projects under the 2009 AHP Extension, the redevelopment of the City owned property at 245-247 Crichton Street, and the Shepherds of Good Hope Proposal to acquire and convert the property at 1053-1057 Merivale Road to supportive housing. In addition, on July 8th, 2009 Council approved the following report, http://ottawa.ca/calendar/ottawa/citycouncil/occ/2009/07-08/cpsc/03%20-%20ACS2009-COS-SOC-0014%20Affordable%20Housing.htm that provided the following authority:

 

1.         That Housing Services Staff proceed with a Request for Proposals, under Action Ottawa, to identify construction ready affordable housing projects that meet the Canada-Ontario New Affordable Housing Program (2003), Rental and Supportive Component, AHP Extension (2009) (Guidelines soon to be released);

 

 2.        That the Manager of Housing Services be authorized to recommend to the Minister of Municipal Affairs and Housing successful projects selected by the 2009 Action Ottawa Selection Committee for funding under the extended Canada-Ontario Affordable Housing Program.

 

 3.        Upon receipt of confirmation from the Minister of Municipal Affairs and Housing of an allocation to the City for project specific funding under the extended Canada-Ontario Affordable Housing Program, that staff be directed to negotiate a Municipal Housing Project Facilities Agreement for each proponent to secure permanent rental affordable housing units under Action Ottawa and exemption from estimated development charges subject to: (i) the affordable housing proponent executing a contribution agreement with the City of Ottawa that provides for funding under the extended Canada-Ontario Affordable Housing Program for the project, (ii) the Municipal Housing Facilities By-law (2006-1) and (iii) Council enacting a Municipal Housing Project Facilities By-law for this project.

 

4.         That the City Clerk and Solicitor be authorized to forward a project specific Municipal Housing Project Facilities by-law for each project directly to City Council for enactment in accordance with the Municipal Housing Facilities By-law 2006-1, subject to successful negotiation and execution of the Municipal Housing Project Facilities Agreement for the project.

 

Following Council Approval above, staff then released an Action Ottawa Request for Proposals.  Successful projects selected by the 2009 Action Ottawa Selection Committee were recommended to the Minister of Municipal Affairs and Housing under the extended 2009 Canada-Ontario Affordable Housing Program. In October 2009, a total of 11 projects, comprising of 406 dwelling units, were submitted to the Ministry of Municipal Affairs and Housing to be considered for funding in 2009/2010. On November 5th, 2009, the Ministry of Municipal Affairs and Housing issued a Conditional Letter of Commitment to the Incorporated Synod of the Diocese of Ottawa for the Cornerstone Supportive Housing Residence for Women indicating that the project was selected for funding under Year 1 of the AHP (Letter from Assistant Deputy Minister attached as Document 1). 

 

The subject property located at 314 Booth Street will accommodate the new supportive housing facility, known as the Cornerstone Supportive Housing Residence for Women. The proposed three-storey, 42-unit apartment building will be sited at the northeast corner of the subject land. The proposed development will include interior common spaces, counselling and administrative services on the ground floor, and adequate outdoor amenity space.  The proposed building is subject to site plan control approval and has been designed to be compatible and complement the character of the surrounding area.  All internal spaces that are accessed by the residents will have a barrier-free path of travel with some units designed for universal access.  The main pedestrian access to the building will be located along Booth Street. Planting is proposed throughout the site including boulevard and foundation planting along Eccles Street and Booth Street.    

 

The purpose of the City grant in the amount of $180,000 is to provide the following fee relief:

 

(a)    An Estimated $100,000 for Building Permit Fees

(b)   An Estimated $68,00 for Cash in lieu of School Board Fees

(c)    An Estimated $20,000 to fund miscellaneous Planning fees that cannot be waived for Action Ottawa Projects. 

 

Due to the short timeframes and the lack of detailed information related to specific proposals, staff were unable to estimate and include the value of Building Permit fees and other applicable charges in the Action Ottawa Report, which was submitted to Council on July 8th, 2009.  Staffs are now recommending that the additional fee relief requested in this report be approved as conditional grants to further support the project.


The grants shall be included in the Municipal Housing and Project Facilities and Contribution Agreement for the project and are conditional as the Agreement provides that all funding is to be paid back to the City in the event of breach of the Agreement that includes a twenty year affordability requirement for the project

 

Additionally, through the Homelessness Partnerships Strategy, the City contributed $2.1 M towards the cost of purchasing the property for Cornerstone Supportive Housing Residence for Women.

 

RURAL IMPLICATIONS

 

There are no rural implications with this report.

 

CONSULTATION

 

This report was not subject to consultation.

 

LEGAL/RISK MANAGEMENT IMPLICATIONS:

 

There are no legal/risk management impediments to implementing the recommendation in this report.

 

FINANCIAL IMPLICATIONS

 

With the approval of the recommendations contained in this report $188,000 will be transferred from the Affordable Housing Capital Building Fund and be used to create Capital Project “Cornerstone Supportive Housing Residence for Women”.

 

The $6.3M in funding from the 2009 Canada-Ontario Affordable Housing Program Extension will be provided in accordance with milestones in the Municipal Capital Housing Project facility and Contribution Agreement and will be provided by Ministry of Municipal Affairs and Housing directly to the proponent.

DISPOSITION

 

Housing Services will notify the Ministry of Municipal Affairs and Housing of Council approval and recommendation. Upon receiving Ministry approval, Housing Services will inform the proponent that they may proceed with the project.

 

Housing Services will work to ensure timely implementation of all necessary funding agreements for the project.

 

Corporate Development & Environmental Law Branch will forward the project specific Municipal Housing Project Facility by-law to Council for enactment.

 

Corporate Development & Environmental Law Branch will review and approve the form and content of the Municipal Housing Project Facility and Contribution Agreement (MHPF & CA) for the project.

WHEREAS the Action Ottawa – Canada Ontario Affordable Housing Program Extension (2009): Cornerstone Supportive Housing Residence For Women report (ACS2009-COS-CAS-0021) recommends that three conditional grants be included in a Municipal Housing Project Facilities and Contribution Agreement between the City and The Incorporated Synod of the Diocese of Ottawa;

 

AND WHEREAS on November 25, 2009 authorized representatives of The Incorporated Synod of the Diocese of Ottawa submitted a request to City staff for the approved proponent-housing provider for the 314 Booth Street project to be changed from “The Incorporated Synod of the Diocese of Ottawa” to “Cornerstone Housing for Women Foundation”, a corporation without share capital that was incorporated under the Canada Corporations Act by way of grant of Letters Patent dated November 25, 2009;

 

AND WHEREAS the Ministry of Municipal Affairs and Housing issued a Conditional Letter of Commitment dated November 5, 2009 to The Incorporated Synod of the Diocese of Ottawa based on the application that The Incorporated Synod of the Diocese of Ottawa submitted for funding under the Canada-Ontario Affordable Housing Program Extension (2009);

 

AND WHEREAS consent from the Ministry of Municipal Affairs and Housing is required in order for the City to advance funding under the Canada-Ontario Affordable Housing Program Extension (2009) to a proponent-housing provider that is not named in a Conditional Letter of Commitment issued by the Ministry of Municipal Affairs and Housing;

 

 

 

AND WHEREAS City staff have submitted all documentation required by the Ministry of Municipal Affairs and Housing in support of the request for the change in the name of the approved proponent-housing provider and a response from the Ministry of Municipal Affairs and Housing is anticipated by December 8, 2009;

 

THEREFORE BE IT RESOLVED that the recommendation in Action Ottawa – Canada Ontario Affordable Housing Program Extension (2009): Cornerstone Supportive Housing Residence For Women report (ACS2009-COS-CAS-0021) be amended by replacing “the Incorporated Synod of the Diocese of Ottawa” with “the proponent approved by the Ministry of Municipal Affairs and Housing, being either The Incorporated Synod of the Diocese of Ottawa or Cornerstone Housing For Women Foundation”.
