That Council approve that:
1.
Reduced opening hours on Advance Vote Days in certain long-term care
facilities and seniors’ residences, as identified in Document 1, be either from
10 a.m. to 12:30 p.m. or from 2:30 p.m. to 5 p.m.; and
2.
Reduced opening hours on Voting Day in certain long-term care
facilities and seniors’ residences, as identified in Document 2, be either from
10 a.m. to 2 p.m. or from 4 p.m. to 8 p.m.

The Municipal Elections Act, 1996 (“Act”) prescribes that the clerk shall establish the number and location of voting places for an election that is considered to be most convenient for the electors. In particular, Subsection 45(7) prescribes that a voting place shall be provided on the premises of the following:
1. An institution for the reception, treatment or vocational training of members or former members of the Canadian Forces.
2. An institution in which, on nomination day, 20 or more beds are occupied by persons who are disabled, chronically ill or infirm.
3. A retirement home in which, on nomination day, 50 or more beds are occupied.
The Act also provides a municipality with the authority to provide for reduced opening hours on Voting Day where a voting place is only for the use of residents of an institution or retirement home. The purpose of this authority is to increase efficiency since the voting process in many of these locations can be concluded in less than a full day due to a limited number of voters at each site. This also provides for the capacity of one election team to then serve two of these facilities in one day.
At its 24 March 2010 meeting, Council
approved By-law 2010-147 to establish dates and hours of operation for the
advance vote in the 2010 municipal election.
This by-law established Saturday, 2 October 2010 and Thursday, 14,
October 2010 as Advance Vote Days for the 2010 elections.
In addition to the locations prescribed by the Act for Voting Day, certain long-term care facilities and seniors’ residences that are not legislated to have regular Voting Day locations will be designated as a voting place on an Advance Vote Day, with reduced opening hours, as outlined in Document 1.
For the 2006 municipal elections, in accordance with the Municipal Elections Act, 1996, Council enacted a by-law to provide for reduced opening hours for certain long-term care facilities and seniors’ residences that are mandated to have a voting location on Voting Day. The by-law also included advance vote locations with reduced opening hours for long-term care facilities and seniors’ residences.
Elections staff has now consulted with the administrators of the facilities and have identified those where reduced opening hours are feasible for both advance vote days as well as Voting Day. These locations are listed in the attached Documents 1 and 2 respectively.
As a point of reassurance in regard to reduced opening hours, the MEA requires that if an elector is in a voting place at the time for closing, and has not yet voted, the elector is still entitled to vote.
There are no rural implications specifically arising from this report although several of the long-term care facilities and seniors’ residences are located in the City’s rural areas.
All long-term care facilities and seniors’ residences in the City have been consulted in the development of this report.
This is a City-wide report.
There are no legal/risk management implications arising from this report.
This report relates to Governance Objective 3: Commit to and develop a democratic, engaging and visible process to maximize input from residents in the work of Council and in policy development, while ensuring that seniors, new Canadians, women and the economically disadvantaged are included.
There are no technical implications arising from this report.
Funds to operate the advanced votes are available in the 2010 Elections budget.
