BACKGROUND
This report relates to the acquisition of a parcel of land situated
within the boundaries of the South Nepean Town Centre that once acquired will
satisfy two important City initiatives.
The majority of the subject parcel of land, known municipally as 3396
Jockvale Road, is designated as “Major Open Space” with a smaller portion of
the parcel designated “Urban Natural Feature” in the City’s Official Plan (the
“OP”). The portion of the property designated Urban Natural
Feature was evaluated in August 2005 as part of the
Urban Natural Areas Environmental Evaluation Study (UNAEES), and was determined
to have a moderate ecological significance (UNA # 49). Furthermore, lands designated Major Open Space and Urban Natural Feature are subject to the
policies of Section 5.2.1.5 of the OP, which provides that the City will acquire land so designated that are in private
ownership, at the request of the landowner.
In keeping with the above, the owner of the subject property has
requested that the City acquire the property in accordance with these policies.
In conjunction with the above policy, the South Nepean Town Centre
Community Design Plan (the “CDP”) designates a majority of the subject parcel
as “District Park”. Section 8.4 – Greenspace Acquisition and Development within
the CDP provides direction and mechanisms for Council’s acquisition of the
lands designated as “District Park”.
These include raising funds through disposal of surplus City-owned lands
located within the CDP and outright land purchases among others.
In addition to the above initiative, the Transportation Master Plan
identifies a new four-lane arterial link to connect Longfields Drive with
Jockvale Road between Strandherd Drive and the Jock River. The recommended plan
was approved by Council in 2006 as part of an Environmental Assessment Study and
the interim phase two-lane roadway is currently under construction.
As part of the Jockvale Road Environmental Assessment Report, approved
by Council in 2009, the first stage of the Jockvale Road widening will commence
with the construction of the first of two new bridge structures crossing the
Jock River. The ultimate design of this structure, located west of the existing
bridge, will accommodate the southbound lanes of the future four-lane Jockvale
Road and will include two vehicle lanes, a bicycle lane and a sidewalk,
extending approximately 200 metres south and tying back into existing Jockvale
Road.
Initially, the new bridge will accommodate two-way traffic while the
existing bridge will be utilized as a cycling/pedestrian bridge. Ultimately,
this will be replaced with a new structure to accommodate the future northbound
lanes of Jockvale Road. To accommodate the current phase of construction,
property requirements on the west side of Jockvale Road will be required and
are shown as Parcel 1 on the attached Document “1”.
Based on the foregoing, the acquisition of the subject parcel will
satisfy these two important City initiatives.
DISCUSSION
The subject lands are legally described by PIN 04732-0034 (LT) shown as Parcel 1 and 2 on the attached Document “1”. The site contains an area of approximately 4.76ha (11.75 acres).
The site is irregular in shape and is located adjacent to the Jock River. Currently, the site is improved with a residential structure, garage, maintenance shed and various greenhouse structures. Historically the site was used for agricultural purposes, but currently is used as a commercial nursery.
Negotiations related to the sale of the subject property were supported by an independent appraisal and an internal appraisal completed for the City, in order to provide an estimate of market value for the subject land in its highest and best use. The respective appraisals concluded that in consideration of the property’s location within the South Nepean Town Centre, the highest and best use of the property was holding for future use in accordance with land use policies set out in the South Nepean Town Centre Community Design Plan (CDP). This information was shared with the property owner who also had an independent appraisal completed on the subject property. In final reconciliation, negotiations have resulted in an agreement being reached at the consideration of $1,650,000 for the fee simple interest in the land.
The subject lands are improved with various structures that retain short term value to the City for use during the construction period related to the Jockvale Road Widening Project. These include a construction site office and staging area. In addition, the greenhouse structures may, in part, be dismantled and re-used at an alternative City site by the City’s Public Works Department. The short term benefits will off-set demolition costs estimated at about $125,000 to remove the existing structures.
This agreement is recommended for approval.
ENVIRONMENTAL
IMPLICATIONS
The acquisition of the subject property is conditional on the findings of a Phase I/II Environmental Site Assessment completed to the satisfaction of the City, as required. Should the existing soils be found to exceed the residential criteria of Table 3, Residential/Parkland – Soil, Groundwater and Sediment Standards for Use under Part XV.1 of the Environmental Protection Act, R.S.O. 1990, c. E.19, the purchase price will be adjusted based on terms and conditions agreed to by both parties.
RURAL
IMPLICATIONS
There are no rural implications resulting from the purchase of this property.
PUBLIC CONSULTATION
Public consultation for the road widening/bridge construction part of this acquisition was part of the Jockvale Road Environmental Assessment Study that was approved by Council in 2009 and included public meetings. Additionally, the CDP was approved by Council in 2006 and included public meetings.
COMMENTS BY THE WARD COUNCILLOR
Ward 3, Councillor Jan Harder, has been consulted and supports this acquisition. Further public consultation will take place in the future prior to finalizing the ultimate use of this site.
LEGAL/RISK MANAGEMENT IMPLICATIONS
There are no Legal/Risk Management impediments to the implementation of
this Report’s recommendation.
CITY STRATEGIC PLAN
The acquisition of the subject property will facilitate the construction
of a new bridge across the Jock River providing improved access to and from the
expanding Barrhaven South Community for pedestrians, cyclists and vehicles. In
addition, this acquisition supports
the City’s goal of providing a healthy and active community by acquiring lands
designated Urban Natural Feature in the City’s OP and District Park in the CDP.
TECHNICAL IMPLICATIONS

FINANCIAL IMPLICATIONS
Funds are available as approved by City Council on 9 June 2010 under
report ACS2010-CMR-REP-0032, recommendation #4, as amended for the
establishment of a Greenspace Acquisition and Development capital account in the
South Nepean Town Centre totalling $975,000.
Additionally, $200,000 is available from capital account 903179 –
Longfields/Jockvale Link and the balance of $475,000 is available from deferred
revenue account 830015
