COMMITTEE RECOMMENDATIONS

 

That Council approve that:

 

1.             $30,000 be allocated to relocate a traffic signal power cable located on 1492 Caledon Street; and

2.             The provisions of the Notice By-law respecting amendments to the budget be waived.

DISCUSSION

 

The Ottawa Regional Cancer Foundation (ORCF) recently purchased the properties 1492, 1496, 1500 Caledon Street.  A site plan application was filed for a development for the Wellspring Centre.  As part of the circulation process concerning this site plan application, it was determined that a power cable is present on the private property which services pedestrian-activated crossing lights located mid-block on Alta Vista Drive south of Caledon Street.  The power cable is located at the proposed location of a building.  However, the City does not have an easement for this cable.

 

As part of site plan approval, the City does have the ability to request easements for municipal services.  However, in the circumstances of the present situation where the power cable is found in the locations of the proposed building a request for an easement likely would not meet the tests under the Planning Act that a municipality must satisfy in order to impose a condition.  As a result, the only viable option is to have the cable relocated at the City’s cost.  The estimated cost of relocating the cable is $30,000.

City Operations - Public Works

 

Roads and Traffic Operations and Maintenance Branch staff have reviewed the site location and the City can provide for the relocation of the cable.

 

 

LEGAL/RISK MANAGEMENT IMPLICATIONS

 

The tests for imposing a condition of site plan or subdivision is that the condition is reasonable, relevant, necessary and equitable.  Given the impact of the location of the power cable on the proposed building, it is likely that a condition by the City requiring an easement for the cable in its present location would not pass the “reasonable” component of this test and that the municipality therefore has to provide for the relocation of the cable.

 

 

FINANCIAL IMPLICATIONS

 

Account 904902 (2010 Life Cycle Renewal Traffic Control Signals) has sufficient funding available for the relocation of the power cable.  Absent a Council approval, this project would not be on the list of items to be funded this year.
