COMMITTEE RECOMMENDATION

 

That Council approve 219 Carruthers Avenue be exempted from the requirements set out in the Demolition Control By-law to enable the demolition of the building without delay, subject to the Owner agreeing to seed/sod and maintain the property and to not use the property for other interim use between the demolition of the existing building and the time of the construction of any replacement building(s).

Que Conseil approuve que la propriété située au 219, avenue Carruthers soit exemptée de toute réglementation énoncée au règlement municipal des démolitions, afin de permettre la démolition de l’édifice, sans délai, sous réserve que le propriétaire accepte d’ensemencer/de plaquer du gazon et d’entretenir la propriété et ne pas l’utiliser à d’autres fins entre la démolition de l’édifice actuel et la construction de tout édifice de remplacement.

BACKGROUND

 

Pursuant to Section 77 (12) of the Procedure By-law, Councillor Hume requested that the above noted resolution be placed on the Planning and Environment Committee Agenda for the 5 July 2010 meeting.

 

WHEREAS demolitions of residential dwelling units, located in the former City of Ottawa, are subject to the Demolition Control process as set out in the former City of Ottawa Demolition Control By-law;

 

AND WHEREAS applications are normally submitted by the property Owner or developer of a residential dwelling where the replacement residential dwelling is not slated to be constructed immediately following the demolition of the building, likely to afford the property Owner or developer time to crystallize plans for redevelopment;

 

AND WHEREAS a residential dwelling unit located at 219 Carruthers Avenue in the Kitchissippi Ward 15 has been in poor condition for some time, with structural issues to parts of the building, and was subject to an Order to Remedy an Unsafe Building dated June 10, 2010;

 

AND WHEREAS the earthquake of June 23, 2010 has caused further destabilization of the building structure to the point that its failure is imminent and that under Order Prohibiting Occupancy issued by the Chief Building Official on June 25, 2010, has been vacated by the occupants;

 

AND WHEREAS the condition of the building is such that the proposed cost of remediation will far exceed the building’s value and thus, any remedial work is not feasible, nor appropriate;

 

AND WHEREAS, the building constitutes a hazard to the occupants, and the adjacent buildings and public;

 

AND WHEREAS, there is no time to permit the Owner to submit an application under Demolition Control to seek approval to demolish a residential unit without the replacement unit(s);

 

BE IT RESOLVED THAT subject to the Owner agreeing to seed/sod and maintain the property and to not use the property for other interim use between the demolition of the existing building and the time of the construction of any replacement building(s), 219 Carruthers Avenue be exempted from the requirements set out in the Demolition Control By-law to enable the Owner to obtain without delay a demolition permit under the Building Code Act to demolish the building, as soon as possible, due to extraordinary circumstances relating to this property.

 

 

DISCUSSION

 

Planning and Growth Management Comments

 

The Department of Planning and Growth Management supports the motion in view of the compromised condition of the building structure and its hazardous condition.  219 Carruthers Avenue has been in poor condition for some time.  An Order to Remedy an Unsafe Building was issued to the owner on June 15, 2010 as a result of structural issues of parts of the building.  The building condition was further affected by the earthquake of June 23, 2010 and as a result, the structural integrity of the building is completely compromised.  The owner was required to vacate the building under Order to Prohibit Occupancy issued June 25, 2010.  There is an immediate need for the building to be demolished.  The waiver of the Demolition Control By-law will expedite the demolition of the building. 

 

 

RURAL IMPLICATIONS

 

There are no rural implications.

 

 

CONSULTATION

 

This item will be advertised in the local daily newspapers as part of the Public Meeting Advertisement on the Friday preceding the Planning and Environment Committee meeting.

 

LEGAL/RISK IMPLICATIONS

 

The responsibility for the demolition of this building rests with the owner pursuant to the above recommendation.  There are no legal/risk management implications for the City.

 

 

FINANCIAL IMPLICATIONS

 

The Owner will fund the demolition; there are no financial implications to the City.

 

 

DISPOSITION

 

Building Code Services Branch will inform the property owner.

In response to questions from the Chair, Arlene Grégoire, Chief Building Official, confirmed that the building in question was already in poor condition, and the recent earthquake had exacerbated it to the point where it could collapse on its own.

 

That the Planning and Environment Committee recommend Council approve 219 Carruthers Avenue be exempted from the requirements set out in the Demolition Control By-law to enable the demolition of the building without delay, subject to the Owner agreeing to seed/sod and maintain the property and to not use the property for other interim use between the demolition of the existing building and the time of the construction of any replacement building(s).
