That Council approve the amendments to Comprehensive Zoning By-law 2005-250 pertaining to part of 85 Range Road, as outlined in the attached report, and that no further notice be required under section 34 (17) of the Planning Act.

BACKGROUND

 

At its meeting of 24 August 2010, Planning and Environment Committee considered report from the Deputy City Manager of Infrastructure Services and Community Sustainability entitled Comprehensive Zoning By-Law 2008-250 - Anomalies and Minor Corrections - Third Quarter 2010 (ACS2010-ICS-PGM-0139.)

 

As requested by Planning and Legal staff, Committee approved the following motion moved by Councillor Feltmate:

 

WHEREAS the anomalies and minor corrections to Comprehensive Zoning By-law 2005-250 listed in report ACS2010-ICS-PGM-0139 are scheduled for consideration by City Council on 8 September 2010, after consideration by both PEC and ARAC.

 

AND WHEREAS there is some urgency to have Council consider the amendments pertaining to part of 85 Range Road, due to an upcoming OMB hearing.

 

BE IT RESOLVED that the Planning and Environment Committee recommend to Council that the zoning amendments for 85 Range Road and 2865 Riverside Drive be approved.

 

BE IT FURTHER RESOLVED that the amendments to Comprehensive Zoning By-law 2005-250 pertaining to part of 85 Range Road be forwarded to City Council for consideration at its meeting of 25 August 2010

 

BE IT FURTHER RESOLVED that zoning for 2865 Riverside Drive be considered by City Council at its meeting of 8 September 2010.

 

And that no further notice be required under section 34 (17) of the Planning Act.

 

Consequently, the amendments pertaining to 85 Range Road, as reflected in the attached Document 1 and Document 2, are before City Council for consideration at its meeting of 25 August 2010.  The amendments pertaining to 2865 Riverside Drive will be considered by Council at its meeting of 8 September 2010.

 

Staff further advised that, with the exception of the above-noted properties, insufficient notice had been provided for the remaining items on the List of Anomalies and Modifications to Zoning By-law 2008-250 for consideration by Planning and Environment Committee (Document 1 of report ACS2010-ICS-PGM-0139.)  As a result, Committee did not consider those items.  The balance of those items will be considered by Planning and Environment Committee on 14 September 2010, and staff will provide the required notice.

Notice of the public meeting to deal with this amendment was provided in The Citizen and Le Droit, with a listing of the addresses and provisions subject to correction. As well, interested parties have been notified by individual mail.

These changes are of a routine nature to correct anomalies and do not have any legal/risk management implications.

There are no direct financial implications associated with this report.

The dual zoning on this property  has resulted in non-conformance with provisions in the Zoning By-law. 

Amend the zoning of the northerly portion of the property from R5B[492] H(30) to R5B[xxxx] H(30), with Column III – Additional Land Uses Permitted of exception [xxxx] to read,

 

-office limited to a diplomatic mission

 

and Column V - Provisions of exception [xxxx] to read,

 

- despite Section 102, the minimum visitor parking space rate is 0.14 spaces per dwelling unit

- despite subclause 107(1)(a)(ii), the minimum width of a driveway providing access to a parking lot or parking garage for a double traffic lane is 6.0 metres

- the land zoned R5B[xxxx] H(30) and R5B[1761] S255 are and will remain one lot for zoning purposes, notwithstanding the lawful division of a lot pursuant to the Planning Act, as amended, the Condominium Act, as amended or any other similar legislation

- despite clause 110(1)(a) and Table 110, Row (b),  the minimum required width of the landscaped buffer to be provided for those surface parking spaces located along the easterly lot line is 0.9 metres
