That Council approve the waiver of Section 4 of By-law No. 2003-520, the Signs on City Roads By-law to permit the installation of a temporary wayfinding sign system during the reconstruction of St. Joseph Blvd. provided that:

 

a.         The sign system is comprised of “Business Listing” signs, placed along Jeanne d'Arc and Orléans Blvd. or other routes as agreed to by staff, and “Advanced Notice” signs placed in advance of the St. Joseph Blvd. construction area.

b.         The signs be fabricated, installed, maintained and removed by the Heart of Orléans B.I.A.

c.         The signs shall only be placed during the reconstruction of St. Joseph Blvd; and,

d.         In accordance with the City’s Tourism and Public Service Signs Policy the dimensions of the signs are no greater than 60cm in width and 90cm in height.

Que le Conseil d'approuver une dérogation à l'article 4 du Règlement municipal 2003‑520 régissant l'affichage sur les voies publiques afin de permettre la mise en place d'un système temporaire de signalisation pendant les travaux de reconstruction du boulevard St. Joseph, aux conditions suivantes :

 

a.         que le système de signalisation soit composé d'enseignes énumérant les commerces et installées le long des boulevards Jeanne-d'Arc et Orléans ou d'autres routes approuvées par le personnel municipal et d'enseignes d'avertissement installées à l'approche de la zone des travaux du boulevard St‑Joseph;

b.         que les enseignes soient fabriquées, installées, entretenues et enlevées par la ZAC du Cœur d'Orléans;

c.         que les enseignes soient en place seulement pendant les travaux de reconstruction du boulevard St‑Joseph;

d.         que, conformément à la politique de signalisation des lieux touristiques et services publics de la Ville, les dimensions des enseignes ne dépassent pas 60 cm de largeur et 90 cm de hauteur.

That the Transportation Committee recommends that Council approve the waiver of Section 4 of By-law No. 2003-520, the Signs on City Roads By-law to permit the installation of a temporary wayfinding sign system during the reconstruction of St. Joseph Blvd. provided that:

Que le Comité des transports recommande au Conseil d'approuver une dérogation à l'article 4 du Règlement municipal 2003‑520 régissant l'affichage sur les voies publiques afin de permettre la mise en place d'un système temporaire de signalisation pendant les travaux de reconstruction du boulevard St. Joseph, aux conditions suivantes :

BACKGROUND

 

In response to concern expressed by members of the Heart of Orléans B.I.A., a wayfinding sign system is to be developed that, if approved, would assist the travelling public in locating business that are open during the reconstruction of the St. Joseph/ Jeanne d’Arc intersection.

 

 

DISCUSSION

 

The upcoming reconstruction of the St. Joseph/ Jeanne d’Arc intersection will involve traffic diversion and delays. The businesses along the street expressed a concern that the construction will have a significant traffic impact. In response, the Heart of Orléans B.I.A. is proposing a wayfinding sign system that, if installed, will address the concerns.

 

The wayfinding sign system is comprised of two types of signs. The first type of sign, the “Advance Notice” is proposed to be placed in advance of the construction area with the intent to provide advance notice to the travelling public that the businesses are still accessible during construction.  The second type of sign, the “Business Listing” signs are proposed to be placed along Jeanne d’Arc and Orléans Boulevard or other routes as agreed to by staff, to assist both vehicular and pedestrian traffic in locating specific businesses.

 

The size of both signs are in accordance with the dimensions of a small vertical wayfinding sign as noted in the City’s Tourism and Public Service Signs Policy, namely: 60 cm in width and 90 cm in height (24” x 36”).

 

The Heart of Orléans B.I.A. will enter into an agreement with the City stipulating that the signs will be fabricated, installed and maintained by the Heart of Orléans B.I.A.  Further, that the signs will only be installed during the reconstruction of St. Joseph Boulevard after which the signs will be removed by the B.I.A.

 

The Signs on City Roads By-law currently does not permit the installation of the proposed signs.

 

In view of the fact that the reconstruction will have a significant impact on the business along St. Joseph Boulevard and that the signs will be installed at no cost to the City, it is recommended that Section of 4 of the Signs on Roads By-law be waived to allow the temporary installation of these signs, as provided for by the conditions in the recommendation.

 

 

 

CONSULTATION / PUBLIC NOTIFICATION

 

The Heart of Orléans B.I.A. is in support of this report and has expressed no concerns.

 

By-law and Regulatory Services Branch

 

Should the recommendation be approved, By-law and Regulatory Services will enforce the relevant by-law accordingly and as necessary, on a Request for Service basis.

 

 

LEGAL/RISK MANAGEMENT IMPLICATIONS

 

Since Council enacted the by-law referenced in this Report it is within Council’s jurisdiction to waive the application of a particular provision in appropriate circumstances.  In such event, there would be no adverse Legal/Risk Management implications for the City.

 

 

FINANCIAL IMPLICATIONS

 

No financial implications will result from the recommendations.

 

 

DISPOSITION

 

Staff of the Right-of-Way By-laws, Permits and Inspections Unit of the Department of Planning and Growth Management to take appropriate action as directed by the Committee, and will advise the proponent.
