Committee Recommendation
That Council direct
staff to undertake a comprehensive review of the City of Ottawa’s Encroachment
By-Law as it relates to ‘Outdoor Patio Encroachments’ including the fee
structure, as well as the delegated authority and appeal process, and report
back to Committee and Council by the first quarter 2011.

That the Transportation Committee recommend

On 23 August 2010, the Transportation Committee received the aforementioned Notice of Motion with respect to the above. A full copy of the Motion is attached as Document 1 to this report.
The
City of Ottawa’s Encroachment Bylaw, being By-law No. #2003-446, has not been
the subject of a comprehensive review since it was enacted in September 2003. Some BIAs have expressed concern that the
dual fee structure for patios is both confusing and too expensive for many
restaurants and bars in Ottawa.
Planning and Growth Management
A comprehensive review is part of regular by-law administration and the Encroachment By-law (2003-446) was scheduled for such a review in 2011. While, the motion will advance the review, staff have no objections to the motion.
The comprehensive review will be done by existing staff, no direct financial implications.
LEGAL / RISK MANAGEMENT
IMPLICATIONS
There are no legal or risk management impediments to implementing the recommendations of this report.
RURAL IMPLICATIONS
There are no rural implications.

WHEREAS the City of Ottawa’s Encroachment Bylaw, being By-law
No. #2003-446, has not been the subject of a comprehensive review since it was
enacted in September 2003;
AND WHEREAS
members of Preston Street Business Improvement Area have recently expressed
their concern that the dual fee structure for patios is both confusing and too
expensive for many restaurants and bars in Ottawa;
AND WHEREAS the
motion to review the application for the owner at 158 MacLaren Street is
symptomatic of the procedural and administrative confusion that surrounds the
exemption process under this by-law;
THEREFORE BE IT
RESOLVED THAT staff be directed to undertake a comprehensive review of the City
of Ottawa’s Encroachment By-Law as it relates to ‘Outdoor Patio Encroachments’
including the fee structure, as well as the delegated authority and appeal
process and report back to Committee and Council.
