The Mayor, Jim Watson, presided and led Council in prayer.

COMMITTEE RECOMMENDATION

 

That Council approve that the City of Ottawa consent to an order deleting the following conditions on the basis that the Owner provides a letter agreeing that such is without prejudice to the City seeking to impose similar conditions on a subsequent development application.

 

These are the conditions that the City should not defend:

 

a.                  Condition 1, which in effect, requires the granting of road widenings from the Gas Bar property to the City of Ottawa;

b.                  Condition 2, which in effect, requires the granting of a corner sight triangle from the Gas bar property to the city of Ottawa;

c.                   Condition 3, requiring the removal or relocation of underground storage tanks from the land conveyed for the road widening and sight triangle;

d.                  Condition 4, requiring an agreement between the Owner of the Gas Bar lands and the City of Ottawa, with respect to Condition 3;

e.                   Condition 5, requiring the Owner of the Gas Bar lands to post security with the City of Ottawa respecting the performance of Conditions 3 and 4;

f.                   Condition 6, which in effect, requires a Phase 2 Environmental Site Assessment on the Gas Bar property and the Crossroads property; and,

g.                  Condition 7, which requires the Owner of the Gas Bar property to add the City as an additional insured on the Crossroads property.

This item was dealt with In Camera pursuant to Subsection 13 (1)(d), (e) and (f) of Procedure By-law 2006-462.  This report cannot be reported out for the following reasons:

 

Pursuant to direction of Council provided at Motion 89/4 on 12 May 2010, the subject matter of this report centres around consideration of labour relations and negotiations with the ATU 279 and CUPE 5500. More specifically, it relates to establishing mandates for, and directing staff in relation to, bargaining for the renewal of collective agreements expiring on March 31, 2011, in respect of which each of the unions has served Notice to Bargain.

 

In accordance with the provisions of Subsection 239(2)(d) of the Municipal Act, 2001, as well as Subsection 13(6) of the Procedure By-law, the subject matter of this report deals with “labour relations and employee negotiations.” Therefore, the report may be received and considered by the Transit Commission and City Council, and direction given to staff, in closed session.

 

It is presently expected that collective bargaining with these unions will continue for some time.  Further, the City will be engaging in collective bargaining with its remaining unions in 2012, as their respective agreements expire on December 31, 2011.  As the disclosure of the City’s collective bargaining strategies and mandates for these two Transit unions would likely impact on negotiations with the City’s remaining unions, making this report public may detrimentally affect the City’s overall labour relations interests.   As such, this report will not be made public. 

 

Council resolved In Camera later in the meeting to consider this item but the dispositionof same is shown directly below for ease of reference.

(1) (d) labour relations or employee negotiations; (e) litigation or potential litigation, affecting the City, including matters before a tribunal; and (f) the receiving of advice that is subject to solicitor-client privilege, including communications necessary for that purpose, of Procedure By-law 2006-462, with respect to Interim Transit Commission Report 3 (In Camera), Item 1, Transit Collective Bargaining Mandates, to receive an update on the City’s preparations and proposed mandates for collective bargaining with the ATU Local 279 and CUPE Local 5500.

Upon resuming in open session, Mayor Watson that Council had met In Camera to deal with the Interim Transit Commission Report 3 (In Camera), Item 1, Transit Collective Bargaining Mandates, specifically to receive an update on the City’s preparations and proposed mandates for collective bargaining with the ATU Local 279 and CUPE Local 5500.  The details of this report cannot be reported out for the reasons stated above.  There were no votes taken during the In Camera session, other than to give direction to staff regarding the negotiations or to deal with procedural matters.

1.             East-West segregated bike lane pilot project

COMMITTEE RECOMMENDATIONS AS AMENDED

 

That, subject to funding approval in the 2011 Budget, Council:

 

1.                  Approve the implementation of an East-West Segregated Bike Lane Pilot Project on Laurier Avenue West as described in this report and shown in Documents 1 and 2;

 

2.                  Direct staff to amend the Traffic and Parking Bylaw No. 2003-530 in conjunction with the implementation of the proposed changes to the stopping, parking and loading areas within the study area;

 

3.                  Direct staff to undertake performance monitoring as part of the pilot project, including a Traffic Impact Assessment Report, and to report these findings back to Transportation Committee within 24 months after the pilot has been implemented;

 

4.                  Direct staff to pursue a multi-use pathway for public use through the development application process at 422 Slater Street as indicated in the City of Ottawa Escarpment District Plan and shown in Document 1; and

 

5.                  Delegate authority to the Manager, Roads and Traffic Operations and Maintenance of the Public Works Department to allow the closure of the bike lanes if conditions are unsafe (i.e. black ice).

 

6.         Direct staff to consult with businesses as required during the detailed design phase of the SBL project with a goal to resolve individual concerns related to the roadway design and access to commercial buildings.

WHEREAS the 46 existing on-street parking spaces on Laurier between Bay and Bronson will be removed as a result of the Segregated Bike Lane Project;

 

AND WHEREAS many residents are senior citizens and visitor parking is essential for personal care workers, deliveries, repair services as well as family members and friends;

 

THEREFORE BE IT RESOLVED that staff from Planning and Growth Management, Real Estate and Public Works continue to be involved in the process to identify parking opportunities near Laurier Avenue West between Bay Street and Bronson Ave.

WHEREAS Canada Post closed Orléans’ only corporate post office outlet on Youville Drive on July 31, 2010 despite the protest and petitions signed by thousands of Orléans’ residents and businesses; and

 

WHEREAS our federal MP Royal Galipeau has written numerous letters supporting the reopening of an Orléans Post Office; and 

 

WHEREAS Canada Post has failed to live up to its obligations as outlined in the Canada Postal Service Charter by failing to engage and listen to the community; and

 

WHEREAS business customers who used the corporate post office on Youville Drive to purchase and drop-off their admail now must travel to the Ottawa Alta Vista or Vanier facilities; and

 

WHEREAS the Canadian Union of Postal Workers (CUPW) has agreed to finance the costs associated with relocating the corporate postal outlet in the same general area on St-Joseph Boulevard through its joint union-management fund used to finance innovation and expansion projects under Appendix “T” of its collective agreement, thus limiting the risks to the Corporation to a minimum;

 

THEREFORE BE IT RESOLVED that the Ottawa City Council encourage the Canada Post Corporation to reconsider the Canadian Union of Postal Workers’ offer to finance the relocation of the Orléans corporate post office under Appendix “T” of the collective agreement.

WHEREAS the City of Ottawa has successfully hosted numerous national and international major events to the benefit of the local economy;

 

WHEREAS the bid deadline of end of February does not allow for a staff report to Committee and Council for consideration;

 

AND WHEREAS local hotel and conference facilities and ScotiaBank Place will be in a position to host the 2013 Canadian Curling Trials;

 

BE IT RESOLVED that the City of Ottawa formally support the bid by Senators Sports and Entertainment to host the 2013 Canadian Curling Trials, scheduled for December 1 - 8, 2013;

 

BE IT FURTHER RESOLVED that Council authorize funding contribution of approximately of up $400,000 (in cash and in-kind services);

 

BE IT FURTHER RESOLVED that staff report back to Finance and Economic Development Committee on any funding needs over and above the proposed City of Ottawa contribution to the 2013 Canadian Curling Trials.

WHEREAS  the Government of Canada has provided settlement partnership funds for programs that operate in public libraries across Canada, enabling new Canadians opportunities to more rapidly integrate into Canadian society; and

 

WHEREAS the Ottawa Public Library has successfully used the moderate funds allocated to provide many services to new Canadians from many countries of the world; and

 

WHEREAS despite an increase in demand for such services, the Government of Canada has reduced the settlement partnership grant to the City of Ottawa by 20% and such reductions have been made in settlement partnership grants across Canada; and

 

WHEREAS the Ottawa Public Library supports the resolution before Council;

 

THEREFORE BE IT RESOLVED that the City of Ottawa urge the Federation of Canadian Municipalities to strongly request the Government of Canada to maintain current funding for the Library Settlement Partnership program currently operating in public libraries across Canada.

WHEREAS the City of Ottawa, through Schedule 2 of its Licensing By-law 2002-189, licenses driving school operators and driving instructors;

 

AND WHEREAS in 2007, Council amended Schedule 2 to prohibit driving instruction within a defined area adjacent to the Ministry of Transportation test facility at 5303 Canotek Road in order to address on-going issues with increased traffic and potential safety concerns in the residential area adjacent to the test facility;

 

AND WHEREAS for several years similar issues have been on-going in the residential area adjacent to the driving test facility at 1570 Walkley Road;

 

AND WHEREAS City staff has, on two occasions in the last year, notified in writing driving school operators and driving instructors of the issues and requested cooperation in directing driving instructors to cease using specified residential streets for student instruction, but no improvement in the situation has been demonstrated;

 

AND WHEREAS there continue to be serious safety concerns expressed by the community in this regard and there is an absence of cooperation from the driving schools, and therefore the matter is time sensitive;

 

AND WHEREAS City staff support restricting driving instruction in the Ridgemont Community;

 

THEREFORE BE IT RESOLVED THAT Council waive the notice requirements prescribed by By-law No. 2002-522 respecting public notice, as amended; and,

 

BE IT FURTHER RESOLVED THAT Council approve amendments to Schedule 2 of By-law 2002-189, as detailed in the attached amending by-law, to prohibit driving instruction within a defined area adjacent to the Ministry of Transportation test facility at 1570 Walkley Road, and to correct a minor typographical error in the description of Area A (area surrounding test facility at 5303 Canotek Road).

WHEREAS the Ontario Lottery and Gaming Corporation, in partnership with the Rideau Carleton Raceway, has operated slot machines at the Raceway’s location since the year 2000; and,

 

WHEREAS the former City of Gloucester and the former Regional Municipality of Ottawa-Carleton supported the successful application for slot machines at the Rideau Carleton Raceway; and

 

WHEREAS in 2009, City Council supported the successful application of the Rideau Carleton Raceway to the Alcohol and Gaming Commission of Ontario to open a new charity bingo hall; and

 

WHEREAS the Rideau Carleton Raceway has contributed over $37 million to the City since the introduction of slots in 2000; and over $4.4 million in 2010 to the City of Ottawa as part of a long-standing revenue sharing agreement; and

 

WHEREAS the Rideau Carleton Raceway is seeking  a two-year pilot project to establish table games that would  increase its contributions to the City of Ottawa Treasury by approximately $2 million per year; and

 

WHEREAS there are other economic development, tourism development and spin-off employment opportunities that will benefit the community as gaming tables are introduced alongside slot machines at the Rideau Carleton Raceway; and

 

WHEREAS Section 207.1 of the Criminal Code stipulates that the Provinces are responsible for gaming in Canada and the Ontario Lottery and Gaming Corporation has the authority to provide for the operation of gaming premises in Ontario;

 

THEREFORE BE IT RESOLVED THAT City Council communicate its support in principle of the petition to the Province of Ontario by the Rideau Carleton Raceway to direct the Ontario Lottery and Gaming Corporation to permit gaming tables at the Raceway as a two-year pilot project, subject to any required rezoning and any relevant legislation such as the Ontario Lottery and Gaming Corporation Act, 1999.
