That Council approve an amendment to the Zoning By-law 2008-250 to:

 

1.                  Amend the RU[42r] - Rural Countryside [rural exception 42] Zone as it relates to 1721 Old Montreal Road, as shown in Document 1 and as detailed in Document 2, and;

 

2.         Change the zoning of 1731 Old Montreal Road from RU[42r] - Rural Countryside [rural exception 42] to RU - Rural Countryside, as shown in Document 1 and as detailed in Document 2.

BACKGROUND

 

The zoning application affects two parcels of land known as 1721 and 1731 Old Montreal Road.  The parcels are located north of Old Montreal Road, south of Regional Road 174, and west of the intersection of Old Montreal Road and Quigley Hill Road.  Agricultural uses are located immediately to the east.  Surrounding the parcels to the north, south and west are residential uses on parcels of varying sizes, ranging from country-lot estate subdivisions to residences on very large, wooded lots.

 

Existing Zoning

 

The affected land is zoned RU[42r] - Rural Countryside [rural exception 42].  This zone permits a range of rural-based uses including agriculture, forestry and residential lots created by severance.  The exception adds the following permitted use: “Planned Unit Development” and the following restriction: “despite Section 131, Planned Unit Development, the provision of said section do not apply and instead the provision of the RU zone apply with a maximum number of four detached dwellings.”

 

Purpose of Zoning Amendment

 

Part 1 of the zoning application fulfills a condition of consent.  The affected land was the subject of two reciprocal consent applications granted by Committee of Adjustment (D08-01-10/B-00282 and D08-01-10/B-00283).  Consent Application D08-01-10/B-00282 created a vacant 17.79 hectare parcel to be known as 1731 Old Montreal Road.  Consent Application D08-01-10/B-00283 created a 24.28 hectare parcel known as 1721 Old Montreal Road.  There is an existing dwelling on this parcel.

 

Part 2 of the zoning application is to address a technical oversight that was not detected during the consent application process.

 

DISCUSSION

 

Official Plan 

 

According to the Official Plan, the affected lands are designated “General Rural Area”.  This designation permits a variety of land uses that are appropriate for the rural area including rural housing, farms, wood lots/forests, small industries, golf courses, and in many places small clusters of residential and commercial development. 

The intent of this designation is to accommodate land uses that are appropriate for a rural location, and a limited amount of residential development where such development will not preclude continued agricultural and non-residential uses.

 

Details of Proposed Zoning 

 

1721 Old Montreal Road

 

It is proposed to rezone 1721 Old Montreal Road from RU[42r] - Rural Countryside [rural exception 42] to RU[42r] with an additional provision to permit a lot width of 20 metres.  Currently, the required minimum lot width in the RU Zone is 50 metres for a residential use.

 

As a condition of consent, the Applicant was required to provide a 20 metre strip of land that provides this parcel with frontage along Old Montreal Road.  This parcel also has frontage along Regional Road 174.  However, it is not accessible frontage and access is currently achieved via a right-of-way across neighbouring properties.  If this right-of-way was to no longer exist, the 20 metre strip of land with frontage on Old Montreal Road would ensure this parcel has its own accessible frontage to a public road (Old Montreal Road).  At the time the condition was imposed, it was determined that a 20 metre strip of land would be sufficient for any future driveway to provide access to the existing dwelling on the lot.  However, since accessible frontage is from Old Montreal Road, the required lot width along this road must meet the provisions of the Rural Countryside Zone (RU) which is 50 metres.  The proposed rezoning would amend the zone provisions for this parcel to permit a lot width of 20 metres rather than 50 metres.

 

1731 Old Montreal Road:

 

It is proposed to rezone 1731 Old Montreal Road from RU[42r] - Rural Countryside [rural exception 42] to RU.  Following the consent application this parcel will be vacant.  The current rural exception [42r] permits a maximum of four detached dwellings on the parcel.  By rezoning this property to remove the exception, the RU zone provisions will then apply and only one detached dwelling would be permitted on the lot.  The effect of this rezoning will reduce the development potential of this parcel.

 

ENVIRONMENTAL IMPLICATIONS

 

The parcel that will be known as 1731 Old Montreal Road is adjacent to an area of potential significant woodland.  However, by reducing the development potential on this parcel the impact on the environmental feature is negligible.

 

RURAL IMPLICATIONS

 

The rezoning of the parcel to be known as 1731 Old Montreal Road supports City policy to maintain the rural character and allow for limited residential property.  The development on this property is being limited to one new dwelling.  As well, no further severances will be permitted on the affected lands due to existing City policy on severances in the rural area.

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy.  Details of public comment are provided in Document 3.

(a)           1731 Old Montreal Road is rezoned from RU[42r] to RU

 

2.        Exception [42r] of Section 240 - Rural Exceptions of By-law No. 2008-250 is amended as follows:

 

(a)           add the following provision to Column V

NOTIFICATION AND CONSULTATION PROCESS

 

Notification and public consultation was undertaken in accordance with the Public Notification and Public Consultation Policy approved by City Council for Zoning By-law amendments.  Notice of the application was circulated to neighbours within 120 metres of the subject lands as well as to the community association. 

 

PUBLIC COMMENTS

 

The initial input provided by two neighbours following the circulation process is summarized below.  Staff response to each comment/concern immediately follows each point.

 

SUMMARY OF PUBLIC INPUT

Comment: Concern was expressed regarding the historic situation of water runoff leaving the affected lands from the north side of the property and its impact on nearby wells.  As well, it was questioned when public water and sewer would be extending to the area.

 

Response: The proposed rezoning for 1721 Old Montreal is to address a lot width requirement for frontage on Old Montreal Road along the south property line.  No new development is being proposed on this parcel.

 

The proposed rezoning for 1731 Old Montreal is to reduce the number of permitted dwellings on the lot to only one.  No development is proposed at the current time.  When a new dwelling is proposed, a grading and drainage plan will be required as part of the building permit application.

 

City services are presently not planned to be extended beyond the urban boundary to the rural area.  Contact information was provided if additional information was required on the extension of services to the rural area.
