The Council of the City of Ottawa met at Andrew S. Haydon Hall, 110 Laurier Avenue West, Ottawa, on 27 April 2011 beginning at 10:00 a.m.
The Mayor, Jim Watson, presided and led Council in prayer.
The National Anthem was performed by
the students from Bayshore Catholic School.

RECOGNITION – CITY
BUILDER AWARD
Mayor Watson presented the Mayor’s City Builder Award to Michaela Noffke
in recognition of her leadership, dedication and volunteerism. Micheala is an
accomplished and awarded dance instructor and an avid volunteer.
RECOGNITION – CITY OF OTTAWA AWARD FOR HEROISM
Mayor Watson presented the City of Ottawa Award for Heroism to Brian Nielson and Eric Dessureault in recognition of their rapid intervention in providing first aid to a recreational hockey player in cardiac arrest at the Tom Brown Arena on April 5th, 2011.

PROCLAMATION
Mayor Watson presented Ms Hélène
Sinclair and Ms. Laurie-Jean Smith of the International Association of
Administrative Professionals of Ottawa and the International Association of
Administrative Professionals of Ottawa West with framed copies of the Administrative
Professionals Week Proclamation. Mayor Watson declared April 24th to
April 30th, 2011 as Administrative Professionals Week in the City of
Ottawa.

1. Receive the information in this report
regarding the implementation of an immediate, mandatory ban on all outdoor
water use in Barrhaven, Riverside South and Manotick enacted today by the
Deputy City Manager of Infrastructure Services and Community Sustainability in
order to fulfill the City’s responsibilities under the Safe Drinking Water Act 2002;
2. Approve the implementation of the suite of
measures outlined in this report designed to support voluntary compliance with
the outdoor water use ban;
3. Approve a one-time operating budget
requirement in the amount of $2,055,000 for outdoor water use ban voluntary
compliance measures, critical path communications, and contingency as
identified in this report to be funded from the Water Reserve Fund as permitted
under Water Reserve Fund By-law 2003 –
141;
4. Delegate authority to the Deputy City
Manager of Infrastructure Services and Community Sustainability to expend water
reserve funds as necessary to manage the drinking water system in the impacted
areas in accordance with Water By-law
2003-500 as well as the principles of the Safe Drinking Water Act 2002 and implement any measures required during
the outdoor watering ban; and
5. Approve an amendment to the Water By-law 2003-500, in the form set out in Document 3, in order
to provide for enforcement, including fines, for violations of bans issued
under the by-law.

Hunt Club Road, and enact the associated by-law (Document 2) such that the exemption
of taxes for municipal and school purposes and of municipal development charges
be based on the portion of the facility that will be occupied for the provision
of municipal animal shelter and ancillary services (38.1%) and provided that:
a) an off-setting amount be provided to the Ottawa
Humane Society for education development charges for the above-noted portion of
the facility from the Provision for One-time and Unforeseen Expenditures ($16,300);
and,
b) the municipal portion of the planning
application and building permit fees be funded from a transfer from the
Provision for One-time and Unforeseen Expenditures ($53,900); and,
2. Approve that the City enter into a 25-year
deferral agreement for municipal development charges related to the remaining
portion (61.9%) of the facility.

result of the Federal Government’s purchase of the Nortel Moodie campus.
3. Approve that the Legal / Risk
Management comment be amended to read as follows:
“Since
the interim connection to Moodie Drive is not being constructed in Phase 1, the
Transitway cannot be put into service until the completion of Phase 2. The
construction of Phase 2 requires approximately 1.2 hectares of NCC Greenbelt
land. The NCC is currently undertaking their Greenbelt Master Plan Review and
will not be in a position to approve the sale of the requested property until
after the review is completed, which is expected sometime in 2012. Phase 2
cannot be constructed until the property is transferred.
In the
event that the land transfer did not take place, Phase 1 could not be
utilized. Thus, the risk to the City is
that it would be proceeding with the commencement of construction of Phase 1
before the ability to proceed with Phase 2 is a certainty.”
4. Approve that following the
Environmental Assessment process, the station location of the proposed
Corkstown/Moodie area station be brought back to the Transportation Committee
and Council for consideration.

WHEREAS noise barriers had been envisioned
for the portion of the West
Transitway Extension between Bayshore and Moodie Drive; and
WHEREAS the adjacent community has expressed
a longstanding desire for noise
barriers; and
WHEREAS
the City of Ottawa's one third commitment to funding the noise barriers is
embedded within the project envelope;
WHEREAS
continuing to seek funding for the noise barriers is in the best interest of
the project and the community; and
WHEREAS,
if the City portion of the funds remained within the project, it could not be
expended without matching funds from the Provincial and Federal levels of
government;
THEREFORE BE IT RESOLVED THAT the approved funding for the City of
Ottawa's one third share of noise barriers for the West Transitway Extension
project remain within the project envelope to be expended if and when matching
funds are committed by the Ontario Provincial and Canadian Federal
governments respectively.

WHEREAS
Recommendation 4 of Transportation Report 5A, Item 5 – “West Transitway
extension from Bayshore Station to west of Moodie Drive: Noise barrier funding and
proposed implementation schedule” indicates that the station location for the
Corkstown/Moodie area is to be brought back to Committee and Council following
the Environmental Assessment; and
WHEREAS Section
7 (2) 6.iii of the Environmental Assessment Act, Ontario Regulation
231/08 requires the proponent to have completed an analysis of the impacts the
transit project may have on the environment prior to publishing the Notice of
Commencement of the Transit Project Assessment Process; and
WHEREAS this requirement can only be
satisfied if the location of the station is clearly defined so that staff is
able to analyze any environmental impacts of the station’s location;
THEREFORE BE IT
RESOLVED THAT Recommendation 4 be replaced with the following: “That,
prior to initiating the Transit Project Assessment Process, the location of the
proposed Corkstown/Moodie area station be brought back to the Transportation
Committee and Council for consideration.”

widening of OR 174/Prescott Russell Road 17 be utilized under the following
conditions:

the widening of Highway 417 to fix the split westerly to Nicholas Street is
fully funded with a commitment to implement by 2015;
b. All
costs related to the City of Ottawa’s planned Environmental Assessment from
417/174 split easterly to Jeanne D’Arc be drawn from the Provincial offer of
$5M;
c. The
remaining funds be used to complete the Environmental Assessment of OR 174 /
Prescott-Russell Road 17 from Jeanne D’Arc easterly and that the study be borne
by the Province or the United Counties of Prescott and Russell with the City
providing input on the scope of the study prior to the call for proposals;
d. That
the Environmental Assessment from Jeanne D’Arc easterly look at the downstream
effect on the City’s infrastructure, and that the study include a cost benefit
analysis and a full exploration of all alternatives; and,
e. That
the Environmental Assessment from Jeanne D’Arc easterly requires final approval
by City of Ottawa Council.
2. That
the results of the Environmental Study for the widening of OR 174 from Jeanne
D’Arc easterly be considered and incorporated into the City’s updated
Transportation Master Plan.

Clerk and Solicitor currently provides three separate reports detailing the
City’s Claims Settlements to the Finance and Economic Development Committee, as
well as its Litigation Record and External Legal Costs reports to Committee and
Council; and
WHEREAS, at its
meeting of November 24th, 2010, City Council identified its interest in receiving regular updates
on the costs associated with litigation; and
WHERAS the City
Clerk and Solicitor, in the December 3, 2010 response to the above inquiry,
indicated that the incorporation of the legal outsourcing costs component of
the Treasurer’s Delegation of Authority Report into the quarterly litigation
report would “better align current litigation matters with the costs, but would
also provide a more holistic approach to the legal services functions and
associated costs”;
THEREFORE BE IT RESOLVED that Council direct the City Clerk and
Solicitor to combine the existing Claims Settlements, Litigation Record and
External Legal Costs reports into a single comprehensive report to be presented
to the Finance and Economic Development Committee and City Council quarterly.

objective of the Purchasing By-law respecting procurement is to obtain best
value for the tax payers dollars; and
WHEREAS managing

Purchasing By-law addresses unsatisfactory supplier performance in terms of
failure to meet contract specifications, terms and conditions or for Health and
Safety violations; and
WHEREAS the City
Treasurer may, in consultation with the City Clerk and Solicitor, prohibit an
unsatisfactory supplier from bidding on future contracts;
THEREFORE BE IT
RESOLVED THAT staff formalize the procedure for reporting to Supply Branch
contractor performance including a standardized reporting format for the
purpose of managing operational performance, minimizing risk, proactively
addressing non-performance and when appropriate barring unsatisfactory
suppliers from future City work.

WHEREAS Canada Day is a
national day of celebration; and
WHEREAS the ByWard Market, due
to its proximity to Parliament Hill and because it is a prominent tourist
attraction in its own right, is a natural gathering space for celebrating
Canadians; and
WHEREAS to assist in crowd
control, the Councillor of Rideau-Vanier Ward has, following the process set in
place by the former City Councillor for Bruyere-Strathcona Ward since 1996,
required that all ByWard Market stakeholders be involved in reviewing the
requests to host parking lot parties on Canada Day and sought the input of
Ottawa Police and the Alcohol and Gaming Commission of Ontario – Liquor
Enforcement Section and City staff, to review relevant liquor laws, criminal
laws and City by-laws; and
WHEREAS Ottawa City Council
has, since Canada Day 1996, exempted certain parking lots from the enforcement
of the zoning by-law and other relevant City by-laws for Canada Day weekend
only; and
WHEREAS the City Councillor
consulted ByWard Market stakeholders and the Police and staff from the Alcohol
and Gaming Commission of Ontario – Liquor Enforcement Section and, together,
they reached a consensus as to which parking lots should be exempted from the
provisions of municipal by-laws for Canada Day 2011;
THEREFORE BE IT RESOLVED THAT
the following addresses in the ByWard Market area be exempt from enforcement of
the zoning by-law, specifically the sections which prohibit a place of public
