REPORT RECOMMENDATION

 

That the Planning and Environment Committee recommend to Council that the City of Ottawa complete the required work undertaken by contractors hired by the City – with the costs to be placed on the owner’s property taxes.

Que le Comité de l’urbanisme et de l’environnement recommande au Conseil de donner instruction à la Ville d’Ottawa de confier à des entrepreneurs le mandat de réaliser les travaux requis et d’en ajouter le coût à la facture de taxes foncières du propriétaire.

 

 

BACKGROUND

 

263-65 Bank Street is a surface parking lot fronting onto Cooper Street (south side) east of Bank Street. A commercial public parking operation is located here.

 

A Site Plan Control Agreement registered on June 10, 1980 required soft landscaping at the Cooper Street frontage. This was not fulfilled, and in 1989 enforcement of the agreement was approved by the Planning Committee of the former City of Ottawa.

 

On April 18, 2005 the landscaped area was removed, and illegally converted to additional parking stalls.

 

The owner was advised by letter that if re-instatement of the landscaping was not completed by June 30, 2005, a report to Planning and Environment Committee and Council recommending re-instatement by the City of Ottawa at the owner’s expense would come forward.

 

As almost one year has elapsed since that time, with no re-instatement, this recommendation is being brought forward by the Ward Councillor.

 

 

CONSULTATION

 

There have been on-going discussions with the Director of By-Law Services regarding the enforcement of this Site Plan Agreement.

 

Residents of the condominium buildings are 372 and 364 Cooper Street have been requesting re-instatement of the landscaping in accordance with the City of Ottawa’s policies for landscaping of surface parking lots.

 

 

FINANCIAL IMPLICATIONS

 

$1,670 of financial security was retained in 1980. This was applied to the costs of bringing the site into compliance in 1990.f

Document 1 - Correspondence dealing with the Site Plan from 1980 to 2006, photographs of landscaped elements that were removed and original site plan dated July 1989.

 

 

DISPOSITION

 

Corporate Services, Clerk’s Office, will advise the property owner, Golden Dragon Ho Inc., 338-27 Beechwood Ave., Ottawa, ON, and the Acting Director, Financial Services, of the disposition of this item by Committee and Council.
