REPORT RECOMMENDATION

 

That the  recommend Council approve an amendment to the former City of Gloucester Zoning By-law to change the zoning of 1101 and 1111 Ogilvie Road from Cn - Commercial Neighbourhood Zone to Cn (EXX) - Commercial Neighbourhood (Exception XX) Zone as shown in Document 1 and as detailed in Document 2.

Que le Comité de  recommande au Conseil d’approuver une modification au Règlement de zonage de l’ancienne Ville de Gloucester afin de changer la désignation de zonage des 1101 et 1111, chemin Ogilvie de Cn, zone de commerce de quartier, à Cn (EXX), zone de commerce de quartier (exception XX), tel qu’il est indiqué dans le document 1 et détaillé dans le document 2.

 

 

BACKGROUND

 

The subject lands are located at the northwest corner of Ogilvie Road and Cummings Avenue.  The vacant lot at 1101 Ogilvie Road has been added to the existing manual car wash/gas bar operation at 1111 Ogilvie Road. The applicant's intention is to add to the operation by building a new touchless car wash. The two lots encompass an area of approximately 3250 square metres. Residential uses flank the site to the north and west and there is a plaza on the south side of Ogilvie Road.

 

The existing building was constructed more than 30 years ago. The current zoning recognizes automobile fuel sales as a permitted use; however, the manual car wash has had a legal non-conforming status since December 14, 1999. The proposed zone in the Draft Comprehensive Zoning By-law would allow a car wash.

 

The lands are currently zoned “Cn” - Commercial Neighbourhood under the former City of Gloucester Zoning By‑law. Through this application, it is intended that the properties be rezoned “Cn(EXX)” - Commercial Neighbourhood (Exception). The requested zoning is for the entire site, thereby making the existing use conforming and allowing for the addition of an automatic car wash.

 

 

DISCUSSION

 

Official Plan 

 

According to the Official Plan, the subject lands are designated “General Urban Area”. The General Urban Area designation permits the development of a full range and choice of housing types to meet the needs of all ages, incomes, in combination with conveniently located employment, retail, service, cultural and institutional uses that will facilitate the development of complete and sustainable communities.

 

Zoning By-law

 

The current zoning of the subject lands is “Cn” - Commercial Neighborhood, which permits such uses as automobile fuel sales; commercial offices; convenience stores; day nurseries; institutional uses; medical offices or clinics; personal service businesses; retail businesses and restaurants.

 

Details of Proposed Zoning

 

The applicants have requested a “Cn(EXX)” - Commercial Neighbourhood (Exception) Zone that would make the existing car wash conforming and allow its expansion onto the adjacent lot.

 

Staff consider the proposed zoning appropriate because the additional car wash conforms to the policies of the General Urban Area. These policies permit those uses that provide for the local, everyday needs of the residents, including shopping and services. In addition, the City supports infill development within the General Urban Area as a means of making more efficient use of the existing infrastructure.

No complaints to the existing or proposed car wash have been received in response to this application.  No negative impact pertaining to traffic is anticipated because the uses are situated at the intersection of an arterial road and a collector road. Staff do not anticipate any parking spillover into residential areas as adequate parking will be provided on site and the proposal is oriented on Ogilvie Road. The car wash operation will generate some noise, however this issue can be dealt with through the site plan process; a buffer between the car wash and the residences to the north and west can be required. The lot at 1101 Ogilvie Road is small and is unlikely to be developed on its own. Consequently, it is logical to develop the two properties in unison.

 

Therefore, based on the above-noted considerations, the Department recommends approval of the rezoning proposal.

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation. The City did not receive any negative comments or opposition to this application.
