WHEREAS City Council, as part of the Mid-Term Governance Review report on June 24, 2009, approved Part 1, Recommendation 7 which states that "Standing Committees proceed with confirming the Chairs at the first Standing Committee meeting following the adoption of this report, notwithstanding the Rules of Procedure;”

 

THEREFORE BE IT RESOLVED that the Transportation Committee confirm the appointment of Councillor Maria McRae, as Chair of the Committee until 30 November 2010.

That Transportation Committee:

 

1.         Receive the report entitled King Edward Lane Reduction Impact Study as prepared by Dillon Consulting Limited, dated August 14, 2009, a copy of which is on file with the City Clerk; and

 

2.         Direct staff to carry out Phase II of the study as described in this report, including further consultation with relevant stakeholders, and to report on the results of this work by the end of 2009.

2.         Integrated Street Furniture Program ("ISFP") - City of Ottawa Integrated Street Furniture Policy and Design Guidelines and Request for Proposal Strategy

That Transportation Committee recommend that Council:

 

1.         Approve and endorse the City of Ottawa Integrated Street Furniture Policy and Design Guidelines as discussed in this report and set out in Document 1;

 

2.         Authorize staff to issue an RFP in accordance with the strategy discussed in this report and direct that no further street furniture elements be separated from the ISFP to ensure success of the RFP and the resulting program;

3.         Limit advertising on street furniture elements to transit shelters and information and way-finding kiosks; and

6.         That staff return with a revised version of the present Integrated Street Furniture program, an alternative based on the York Region model where the city prepares the design requirements and then issue a RFP based on the city designs and separates large corporate from local advertisers.

7.         That the ISFP timeline be revised to allow for more time for respondents (to the end of Q1, 2010 – minimum of 6 months from the issuance of the RFP) to prepare their submissions to the City’s RFP.

10.       That the Policy and Design Guidelines be modified to incorporate a Central City designated area where integrated street furniture and restricted advertising potential as proposed by staff is incorporated; and for other areas of the City a more flexible approach be used which permits special BIA design areas, as well as variations for different parts of the City which may also have some of the same elements as the Central City areas (e.g. bus shelters).

11.       That given the size of Transitway style platforms on Rideau Street that size restrictions for advertising be established with the BIA.

3.         GREEN Municipal FLEET PLAN

That the Transportation Committee recommend Council:

 

1.        Approve the updated Municipal Fleet Emissions Reductions Strategy outlined in this report, including the 9 high-priority action items of the Green Municipal Fleet Plan attached as Document 1, which will reduce municipal fleet Green House Gas (GHG) emissions by 3,000 tonnes by 2012, which constitutes 33% of the additional emissions reductions required to achieve the City’s overall proposed GHG reduction target.

 

2.        Direct staff to include in future draft budgets for Council consideration and approval, any operating or capital funding requirements associated with the 24 Green Municipal Fleet Recommendations / Action Items identified in the report.

 

3.        Subject to approval of Recommendation 1, direct staff to include in the 2010 draft budget, the additional costs associated with 10% ethanol blended gasoline ($30,000); Bio-Diesel ($350,000); Bio fuel tanks ($50,000) along with the inclusion in the 2010 draft capital budget of a Green Fleet capital program ($500,000) and Paramedic Rescue Units ESPAR heater retrofits ($100,000).

4.         GRAFFITI MANAGEMENT PROGRAM ENHANCEMENTS - MURAL PROGRAM / LEGAL GRAFFITI WALL MONITORING

That the Transportation Committee and the Community and Protective Services Committee recommend Council approve the following enhancements to the Graffiti Management Program:

 

1.         That the Public Works Department facilitate mural activities to assist with graffiti prevention, as outlined in this report.

 

2.         That a Youth Engagement Mural Program be established in partnership with Crime Prevention Ottawa to support youth and community groups to implement murals in neighbourhoods experiencing high incidence of graffiti vandalism, at an annual cost of $50,000, subject to approval of funding in the 2010 Operating Budget.

 

3.         That the General Manager of Public Works be delegated the authority to expend funds from the existing graffiti eradication operating budget for murals on city assets provided that:

 

(a)        a cost benefit analysis has been completed and supports the mural as a graffiti prevention mechanism;

(b)        the mural meets all requirements of applicable By-laws; and

(c)        community stakeholders have been consulted.

 

4.         That the Chief Building Official, Building Code Services Branch, of the Planning and Growth Management Department, be delegated the authority to permit mural signs, under the Permanent Signs on Private Property By-law 2005-439, that are located on surfaces other than buildings, such as retaining walls, provided that:

 

(a)        the proposed mural sign complies with the size, advertising and location restrictions found in subsections 123(1) and (3) and Section 124 of By-law 2005-439, as amended;

(b)        the surface on which the proposed mural sign is to be placed has been the subject of incidents of graffiti vandalism on a weekly or more frequent basis; and,

(c)        the owner of the property on which the proposed mural sign is to be placed and the relevant Ward Councillor concur; and,

 

5.         That the General Manager of the Planning and Growth Management Department be delegated the authority to permit murals on certain structures located on a highway under the Signs on City Roads By-law 2003-520 provided that:

 

(a)        the proposed mural is placed on a utility box, a retaining wall, a bridge underpass or any other structure located within the highway that has been the subject of graffiti vandalism;

(b)        the proposed mural sign complies with the size, advertising and location restrictions found in subsections 123(1) and (3) and Section 124 of By-law 2005-439, as amended;

(c)        the surface on which the proposed mural is to be placed, has been the subject of incidents of graffiti vandalism on a weekly or more frequent basis; and, 

(d)        the owner of the structure on which the proposed mural is to be placed, and the relevant Ward Councillor, concur.

 

6.         That the legal graffiti walls, located at the George Dunbar Bridge and Ottawa Technical High School, as defined in Section 15 of the Graffiti Management By-law 2008-1, continue to be exempt from the by-law and that:

 

(a)        the monitoring of the Orleans Graffiti Wall, as defined in Section 15 of the Graffiti Management By-law 2008-1, be extended for an additional one-year period; and, 

(b)        no additional legal graffiti walls be implemented.

That the Transportation Committee recommend Council approve the installation of a Traffic Control Signal at the intersection of Ottawa Road 174 and Canaan Road, subject to:

 

1.         The City of Ottawa, United Counties of Prescott-Russell and the City of Clarence-Rockland paying one third each the cost to install the traffic control signal and street lighting;

 

2.         That funds for the City portion in the amount of $86,669 be transferred from account 904464, New Traffic Control Signals Program – Bank and Parkway to a new capital account New Traffic Signal Ottawa Road 174 and Canaan Road with a total budget of $260,000;

 

3.         The City of Ottawa and the City of Clarence-Rockland each paying 50% of the annual maintenance and operating costs of the traffic control signal and streetlighting until such a time that this location meets the warrants for a traffic control signal, at which time, the City of Ottawa would pay 100% of the costs of the traffic signal and of the streetlighting within its boundary; and

 

4.         Execution by the General Manager, Public Works, of an Agreement, which has already been signed by Prescott-Russell and Clarence-Rockland, and which with appropriate payment, liability and indemnification provisions implements the requirements of recommendations 1 and 3.

That the Transportation Committee recommend that Council approve that staff include Lees Avenue sidewalk replacement in its 2009 maintenance budget.

Whereas the Hunt Club Extension is a priority in the City’s Transportation Master Plan and has been contemplated in the former Region's Official Plan since 1983; and

 

Whereas the Ontario Minister of Transportation has agreed to communicate with the City regarding his position about funding 50% of construction of the 417 interchange by early October 2009; and

 

Whereas Phase I (Hawthorne to Russell) of the project will be materially complete by March 31, 2011 and will be placed into service upon completion of Phase II (Russell to Highway 417 including the interchange); and

 

Whereas funding for Phase II is subject to a cost sharing agreement between the City and MTO;

 

Be It Resolved that the Transportation Committee recommend to Council to direct staff to not award the contract for Phase I pending receipt of the Minister's confirmation; and

 

Be It Further Resolved that if the Minister does not provide this confirmation by October 1, 2009 that this issue be brought back to Transportation Committee for consideration.

NOTICE OF MOTION (FOR CONSIDERATION AT SUBSEQUENT MEETING)

AVIS DE MOTION (POUR EXAMEN LORS D’UNE RÉUNION SUBSÉQUENTE)

WHEREAS Sections 63 to 91 of the City of Ottawa Encroachment By-law 2003-446, as amended, provide for the operation of outdoor patios as temporary surface encroachments on municipal highways;

 

AND WHEREAS Section 82 of the By-law 2003-446, as amended, requires that an outdoor patio permit holder shall ensure that the perimeter of the outdoor patio is delineated by a fence or other vertical barrier;

 

AND WHEREAS small businesses such as coffee shops and bakeries may benefit from the placement of small tables and chairs without a perimeter railing;

 

BE IT THEREFORE RESOLVED that Planning & Growth Management staff be directed to amend the Encroachment By-law in order to permit the placement of such encroachments on municipal highways, and to report back to Committee and Council before the end of 2009.

Be it resolved that the bus stops on lawns not be cleared and the savings be identified and returned to the snow removal budget and will be built into future snow removal standards.

Whereas on Sunday July 19, 2009, five cyclists riding single file in a marked bicycle lane on March Road were struck from behind by a motor vehicle, making it impossible to escape injury;

 

Whereas Ottawa’s reputation as a bicycle friendly city has been jeopardized by this horrific accident;

 

Whereas in 2008 there were 292 collisions in Ottawa involving cyclists, and of that number 262 resulted in injuries;

 

Whereas while Ottawa has an exceptional recreational bicycle pathway network, only 2% of city streets have designated bike lanes and less than a kilometre have segregated bike lanes;

 

Whereas cycling should be made safer for residents of all ages and levels of ability;

 

Be it resolved that city staff identify high risk city routes as per accident date, including all those which have seen cycling fatalities, and bring forward a priority investment plan for creating segregated bike lanes to provide physical separation from motorized traffic along these routes.
