That Council:

That the Agriculture and Rural Affairs Committee recommend Council:

Que le Comité de l’agriculture et des affaires rurales recommande au Conseil :

BACKGROUND

 

The subject property, 1565 Dunning Road, is located on the east side of Dunning Road and south of Wilhaven Drive, as shown in Document 1.  Rural residential lots exist to the west and south of the subject lands.  Directly north and east of the subject lands, agricultural lands exist. The site has a frontage of approximately 123 metres on Dunning Road and contains an area of 2.84 hectares.  A 140 square metre structure for storage purposes and a workshop currently occupies the site.

 

Purpose of Zoning Amendment

 

The purpose of the Zoning By-law amendment is to establish a temporary use provision to enable a freestanding garage/workshop to be retained on an otherwise vacant lot, as per a condition of severance approval. The structure is considered ‘accessory’ to the existing residential use at 1583 Dunning Road.  However, as part of the severance process, the existing accessory structure has become separated from the residential use and will be the only use present on the subject land.  As the subject land is not currently devoted to a permitted principal use, an ‘accessory’ structure is not permitted.   The applicants’ intent is to rebuild a house on the severed lot within a year, and at such a time the accessory structure will become compliant with the Zoning By-law.  In the interim, the existing structure requires a Zoning By-law amendment for a temporary period to permit its existence.

 

City of Ottawa Zoning By-law

 

The lands are zoned “Agriculture Subzone 3” (AG3).  The permitted main uses are an agricultural use, an equestrian establishment or forestry on a minimum lot area of 10 hectares with a minimum lot frontage of 60 metres.  The requested zoning relative to this proposal is to provide an exception to the Agriculture Zone to permit the freestanding structure to exist temporarily, for a period of one year.

 

Former City of Cumberland Rural Zoning By-Law

 

According to the former City of Cumberland Rural Zoning By-law, the zone for 1565 Dunning Road is “Agriculture Zone” (AGR).  This zoning permits a single detached dwelling, a kennel, a private stable, a public stable, a veterinary establishment, or a day nursery‑licensed.

 

DISCUSSION

 

Provincial Policy Statement

 

The subject land is within a prime agricultural area.  In prime agricultural areas permitted uses and activities are limited to agricultural uses and agriculture-related uses.  Agriculture-related uses are those that are farm-related commercial and farm-related industrial uses that are small in scale and directly related to the farm operation and are required in close proximity to the farm operation.  Any proposed use shall be compatible with agriculture, and shall not hinder, surrounding agricultural operations.

 

Official Plan

 

According to the Official Plan, the subject land is designated “Agricultural Resource Area”.  This designation is intended to protect the major areas of agricultural production and other lands suitable for agriculture from loss to other uses.  It also ensures that uses that would result in conflicts with agricultural operations are not established in productive farming areas.  As well, all development, including Zoning Amendments for new development, must comply with the Minimum Distance Separation formulae, as amended from time to time.

 

Analysis

 

The proposed use, a freestanding structure for private storage and a private workshop that is being considered under this Zoning By-law amendment meets the policies of the Provincial Policy Statement and the Official Plan.  It is a type of use that will not impede surrounding agricultural operations when in proximity to farm operations.  The Minimum Distance Separation formulae, as is outlined in the Official Plan policies, will not have to apply in this situation, as the proposed use is an existing situation and not considered to be a new development.

 

The Zoning By-law amendment proposal for 1565 Dunning Road with the existing structure is considered appropriate as long as the amendment is for a temporary period.  If a permitted main use under the dominant zone is not introduced within one year of the passing of the enabling By‑laws, the structure for storage and private workshop will become non-compliant.  A large shed or structure remaining on an otherwise vacant site introduces the likelihood that inappropriate uses, considered incompatible to the surrounding pattern of development, may be established.  As the owners have expressed the intent to construct a permitted main use of the dominant zone within a year, permitting a temporary use that will allow the continuance of the existing structure is considered appropriate.

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy.  The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.
