The Council of the City of Ottawa met at Andrew S. Haydon Hall, 110 Laurier Avenue West, Ottawa, on 10 September 2008 at 10:00 a.m.

 

 

The Mayor, Larry O’Brien, presided and the Clerk led Council in prayer.

 

 

The National Anthem was performed by students from Gloucester High School.

 

 

Announcements/Ceremonial Activities

 

PRESENTATION - GOVERNOR GENERAL'S CERTIFICATES OF COMMENDATION

 

Mayor O’Brien presented Mr. Gerry Racine, Mr. Mike Lajoie and Ms. Louise Mailloux with Governor General’s Certificates of Commendation, for their actions on June 27th, 2005 in saving the life of a car accident victim. 

 

 

RECOGNITION - CHILDHOOD CANCER AWARENESS DAY

 

Mayor O’Brien declared Wednesday, September 10th, 2008 as Childhood Cancer Awareness Day in the City of Ottawa.  The Mayor then presented a framed proclamation to Ms. Jocelyn Lamont, Executive Director, Candlelighters Childhood Cancer Awareness Program.

 

 

PRESENTATION - LAUNCH OF THE 2008 CITY OF OTTAWA UNITED WAY / CENTRAIDE EMPLOYEE CAMPAIGN

 

Campaign Co-Chairs, Nancy Schepers, Planning, Transit and the Environment and Councillor Jan Harder announced the official launch of the 2008 City of Ottawa United Way Employee Campaign.

Mayor O’Brien ruled that Council’s decision to deal with this item as the first item of business before the notices of reconsideration essentially made both notices of reconsideration redundant. As such, it would be open for any Member of Council to introduce any motion related to this item, including those motions that were the subject of reconsideration.

 

Following questions of staff and debate by Council, Mayor O’Brien ruled that debate on all motions before Council had concluded.  Councillor D. Deans challenged the Mayor’s ruling.  Mayor O’Brien was sustained on a division of 16 YEAS to 6 NAYS as follows:

3.         That staff develop a list of additional products and materials that could be added to the supplemental program.

WHEREAS the City of Ottawa has approved the collection of Green Bin organics in an effort to increase our waste diversion towards at 60%,

 

AND WHEREAS other municipalities have introduced additional measures to increase diversion along with the implementation of Green Bin collection,

 

THEREFORE BE IT RESOLVED that staff is directed to present to Planning and Environment Committee by November 2008 potential options for increasing diversion from residual waste.

a)         The waste collection companies will provide for bi-weekly pick-up of residual waste from December through to April (adjusted as appropriate to co-incide with the annual changes from/to weekly to/from bi-weekly pick-up of the source separated organics); and

 

b)         Reasonable savings will be provided to the City

WHEREAS the introduction of source separated organics collection represents a major change in the way Ottawa residents place their refuse out for collection,

 

AND WHEREAS the details of this program and its purpose to reduce the City’s dependency on landfills is not clear to many residents,

 

THEREFORE BE IT RESOLVED THAT a full media campaign be undertaken before the implementation of the organics program to raise public awareness of the programs logistics, homeowner’s responsibilities, and why the City is implementing this program,

 

AND BE IT FURTHER RESOLVED THAT particular consideration be given to including a workshop and open house in each ward to accompany the public awareness campaign,

 

AND BE IT FURTHER RESOLVED THAT the department come back to Planning and Environment Committee with a briefing on the final communication strategy before it is implemented.

WHEREAS the City of Ottawa and many municipalities across Ontario have taken steps to recycle and reuse materials in the residential waste stream in order to reduce our dependency on landfills,

 

AND WHEREAS Ottawa continues to encourage residents to be savvy consumers by purchasing items with the least amount of packaging or that use recyclable materials for packaging,

 

AND WHEREAS efforts to reduce the amount of waste produced in the residential waste stream would be more successful if packaging were reduced at the source and only used recyclable materials,

 

THEREFORE BE IT RESOLVED THAT Council call on the Provincial and Federal Government to work with industry to develop voluntary guidelines and enforce legislation where applicable, to reduce packaging and to eliminate the use of non-recyclable packaging materials in consumer goods.

1.         The waiving of:

a)         the requirement of the first meeting before, and preliminary approval by Committee, as prescribed by Section 6(f) and 6(g) of Regional Municipality of Ottawa-Carleton By-law 98 of 1992 to establish procedures and fees for the processing of applications to permit retail business establishments to be open on a holiday;

b)         the requirement that applicants provide a detailed local plan showing the layout of the business premises, description of physical nature of premises, etc., as prescribed by Section 3(f) of the said by-law;

 

2.         subject to the approval of Recommendation 1, Council approve amendments to the Regional Regulatory Code as it relates to tourist area exemptions for the areas outlined below, to:

a)         add to the relevant sections listing exempted holidays, Family Day and any other public holiday declared by proclamation of the Lieutenant Governor to be a holiday for the purposes of the Retail Business Holidays Act, and to harmonize the list of holidays so that they are the same for all the existing by-laws; and,

b)         repeal the Schedules of the existing exemption by-laws that list retail business establishments included in the tourist areas, specifically those outlined below, and replace them with Schedules containing a map showing the perimeter of the business area to which the exemption applies so that all businesses within the delineated area benefit from the exemption.

3.             ACTION OTTAWA 2008 REQUEST FOR PROPOSALS 

 

 

Committee Recommendation

 

That Council approve

 

1.         The July 24, 2008 recommendations for 6 5 projects, totalling 169 155 units, from the Action Ottawa Selection Committee to the Minister of Municipal Affairs and Housing for $1410.091 million of funding under the terms of the Canada-Ontario Affordable Housing Program (AHP);

 

2.         That staff be authorized to seek opportunities to directly allocate the remaining allocation of AHP funds, up to $4.63 million in AHP funding and up to $xxxx100,000 in City incentives be allocated to toward the acquisition of (To be determined) properties for the provision of permanent supportive housing, subject to Council approval based on full financial assessment and qualification of the proposals.

.

 

3.         That up to $650,000 of previously approved authority from the Affordable Housing Building Fund be provided to support the recommended projects and to provide a grant for building permit fees and school board fees, and; an estimated $823,000 in relief from development fees and planning fees be awarded sufficient to fund the projects described in Schedule A, subject to any conditions made by the Selection committee and subject to Council enacting a Municipal Housing Project Facilities By-law for this project;

 

4.         That Staff be directed to negotiate Municipal Housing Project Facilities Agreement with the selected proponent subject to the terms and conditions of the June 28th 2008 Action Ottawa RFP, the Selection Committee recommendations of July 24th, 2008, the provisions of the Municipal Housing Facilities By-law (2006-1), and the limits of the City capital contributions as outline in recommendation 3;

 

5.         That, upon successful negotiation of project facilities agreements with the proponents, authorize the City Solicitor to proceed directly to Council to authorize the project specific Municipal Housing Project Facilities by-law by way of placing the by-law on the Order of the Day for enactment, within the limits set by negotiated agreement, the recommendations in this report, and the Municipal Housing Project Facilities By-law (2006-1).

CORPORATE SERVICES AND ECONOMIC DEVELOPMENT COMMITTEE REPORT 29

 

 

1.             INTENTION TO EXPAND THE somerset street - chinatown BUSINESS IMPROVEMENT AREA BOUNDARY

That Council:

1.         Authorize and direct the City Clerk to send out a notice of Council's intention to pass a by-law to alter the existing BIA boundaries, as defined in Document 1, in accordance with Section 210 of the Municipal Act, 2001;

 

2.         Authorize and direct the City Solicitor to prepare a by-law to designate the area as an expanded Business Improvement Area, as described in Document 1, in accordance with Sections 204 and 209 of the Municipal Act, 2001;

 

3.         Enact the aforementioned by-law in accordance with section 204 and 209 of the Municipal Act, 2001, subject to the    City Clerk receiving favourable results on the notices referred to in Recommendation 1, advising of the intention to pass a by-law expanding the boundary; and

 

4.         Designate the area described by Document 1 as an expanded Business Improvement Area (BIA), under Sections 204 and 209 of the Municipal Act, 2001.

5.   The amendments to the Ottawa Official Plan Volume 2B: Site Specific Policies for the Kanata Town Centre and to the Ottawa (former City of Kanata Zoning By-law) 142-93 and By-law 2008-250 are refused for the following reasons:

 

1)   The proposed development will introduce inappropriate traffic, in terms of:
a) volume,
b) type,
c) time of day
into a residential area

 

2)   The proposed development does not implement sections 2.5.1 and 4.11 of the Official Plan.

 

3)   The site specific Official Plan policies for the Kanata Town Centre direct development of the kind proposed to lands north of the Queensway.

 

4)   The proposed development will not assist to an appropriate degree in achieving the employment objectives for the Kanata Town Centre.

 

5)   The site is not geotechnically appropriate for the proposed development.

THEREFORE BE IT RESOLVED THAT staff be directed to develop a Pets on Public Transit policy, including an amendment to the Transit By-law, to permit the accommodation of pets on the transit system provided they are:

·   in the lap of the transit rider, and

·   traveling in off-peak transit hours;

 

AND FURTHER BE IT RESOLVED THAT this policy include the consideration of the following:   

·   the safety of the operator and bus riders

Committee Recommendations as amended

 

That Council:

 

1.         Approve in principle the guiding principles outlined in this report as the basis for the development of an Integrated Street Furniture Program (ISFP), to be developed in consultation with the community and best practice research;

 

2.         Direct staff to report back in Q1 2009 on the results of public consultation, recommended policy and the specific elements and criteria that will form the basis of the Request for Proposal (RFP);

 

3.         Direct staff to ensure that unsolicited proposals are not accepted from proponents until the formal procurement process has been established.  Further, that any formal or informal communication from potential proponents be included in the formal public consultation.

 

4.         Approve one time funding in the amount of $275,000 to be funded from the City Wide Capital Reserve Fund to meet the requirements necessary for the development of the ISFP as outlined in this report.

 

5.         Approve that the guiding principles of the Integrated Street Furniture Program include accessibility for local business advertising by including, for consultation:

·        That advertising panels intended for local business advertising be 25% of the ad space under the ISFP, and that,

·        That advertising panels intended for local business advertising be limited to less than 1.25 sq. meters, and that,

·        That advertising panels intended for local business advertising be unlit, and that,

·        That advertising panels intended for local business advertising be offered at a cost that is less than 50 % of the published rate for lit panels, and that,

·        That advertising panels intended for local business advertising be offered in single unit quantities.

WHEREAS, community events significantly increase the City’s quality of life and are an opportunity for neighbours to get to know each other resulting in untold benefits;

 

AND WHEREAS, the success of these community events typically involves music and the use of sound amplification devices;

 

AND WHEREAS, the Noise By-law (2004-253) provides the Director of By-law Services the authority to grant exemptions to the event organizers subject to approval of the Ward Councillor and an understanding that the noise will not likely cause a nuisance or disturb the inhabitants or exceed 65 dBA when measured at the point of reception;

And whereas, the fifty ($50) dollar application fee charged for a noise exemption has been deemed a significant hurdle by some community event organizers;

 

AND WHEREAS, the City collects approximately $2,500 per year in revenue from Noise By-law exemption applications related to these types community event;

 

THEREFORE BE IT RESOLVED that the Noise By-law be amended to waive the $50 noise exemption application fee as it relates to noise exemption applications for events that are not-for-profit and are intended for the betterment of the community in which admission is not charged.

 

BE IT FURTHER RESOLVED that Council direct Legal Services to process the amending by-law directly to Council for enactment.

That the Rules of Procedure be suspended to consider and approve the following motion:

 

WHEREAS the City of Ottawa has successfully hosted the Association of Municipalities of Ontario Annual Conference for four years and will once again host the conference next year to the benefit of the local tourism economy;

 

AND WHEREAS local hotel and conference facilities will be in a position to host the 2011 AMO conference;

 

BE IT RESOLVED that the City of Ottawa participate in a Request For Proposal process in partnership with the Westin Hotel, the Ottawa Congress Centre, Tourism Ottawa and the Fairmont Chateau Laurier to host the AMO conference in 2011.

 

BE IT FURTHER RESOLVED that the City of Ottawa commit to the responsibilities laid out in the RFP, mirroring its current commitment to the annual conference, specifically that;

 

 

BE IT FURTHER RESOLVED that staff report back to Corporate Services and Economic Development Committee on any significant funding needs over and above the current City of Ottawa contribution to the AMO conference and that staff seek out sponsorship in order to cover costs where possible if Ottawa is chosen to host the 2011 AMO Conference.

WHEREAS municipalities are faced with a funding imbalance receiving only eight cents of every tax dollar collected, with the other 92 cents going to the Federal and Provincial governments;

 

AND WHEREAS the municipalities deliver the majority of services that residents use;

 

AND WHEREAS municipalities across Canada, are faced with infrastructure deficits and do not have adequate funds to cover these costs, along with the cost of delivering services;

 

AND WHEREAS a Federal election has been called for October 14, 2008;

 

AND WHEREAS Members of Council have put together the following list of questions regarding municipal issues for consideration by residents to ask their local candidates during the Federal election campaign;

 

BE IT RESOLVED THAT City Council accept the following list of questions for use during the Federal campaign;

 

BE IT RESOLVED THAT staff incorporate the questions in a questionnaire to be sent to all local Federal candidates, requesting their responses by September 30, 2008;

 

AND BE IT FURTHER RESOLVED THAT staff post both the questions and responses on the City of Ottawa website for residents' use;

 

1.                What is your party’s position on establishing stable, long-term funding for Ottawa’s Rapid Transit Network?  How much will your party commit to funding the $4 billion Ottawa transit expansion plan?

2.                Will your party commit to providing funding to municipalities, in addition to the Building Canada Fund, to adequately and permanently fund infrastructure improvements so that municipal governments can address rehabilitation of infrastructure such as sewer and water systems, roads and bridges?

3.                Will your party commit to developing a national housing strategy?

4.                Will your party commit to maintaining the current $2 billion in Federal sustainable funding for social housing?

5.                Will your party support the development and implementation of a national childcare program?  If yes, when?

6.                Will your party support cultural infrastructure in Ottawa including the Concert Hall?  Will your party agree to keep the Portrait Gallery in Ottawa?

7.                Will your party support extending and increasing funding for cultural, local arts and heritage programs?

8.                Will your party commit to building a bridge east of the Macdonald Cartier Bridge within the next five years to eliminate truck traffic from the heart of the City of Ottawa?

9.                In late October, the Ottawa Community Housing Corporation will be releasing a Building Condition Assessment Report, outlining the funds required to repair all of their housing stock to bring the stock up to today’s standards.  Will your party assist the municipality in funding the necessary repairs?

10.            Will your party support full recovery of the costs associated with security and policing unexpected events in the Nation’s Capital?  Will your party cover costs incurred by the city for emergency preparedness?   If yes, what is your intended plan?

WHEREAS it has been recognized that municipalities are the growth engines of the Canadian economy;

 

AND WHEREAS municipalities are faced with severe funding issues related to the services they must deliver;           

 

AND WHEREAS a Federal election has been called for October 14, 2008;

 

AND WHEREAS it is important that the political parties provide their positions regarding municipal funding issues;

 

THEREFORE BE IT RESOLVED THAT Ottawa City Council invite the leaders of the four Federal political parties, the Conservatives, the Liberals, the New Democratic Party and the Green Party, or their local designate to a public forum to be held at Ottawa City Hall to answer questions from Councillors about issues of importance to the City of Ottawa;

 

BE IT FURTHER RESOLVED THAT a steering committee comprised of City Councillors Deans, Wilkinson, Feltmate and Harder be appointed to work with the City Manager’s Office to organize the all-candidate’s forum at City Hall to be held prior to the end of September 2008.

WHEREAS the City of Ottawa has statutory responsibility over the “economic, social and environmental well-being of the municipality” and is also responsible for managing sewer and wastewater in an environmentally responsible and efficient way and continues to rehabilitate those parts of the City serviced by aging combined storm and sanitary sewer systems with appropriate investments in sewer infrastructure, technologies and systems;

 

AND WHEREAS the Ottawa River is relied upon as a source of drinking water, recreation, tourism, as well as being an important part of Ottawa’s environment, natural beauty, and history;

 

AND WHEREAS the City of Ottawa has been charged with two violations of the Ontario Water Resources Act and will appear before the Ontario Court of Justice (Provincial Offences Court)  on September 11, 2008, in response to those charges relating to the August 2006 discharge of sanitary sewage into the Ottawa River following the malfunction of the Keefer Regulator;

 

THEREFORE BE IT RESOLVED THAT:

1.         Council acknowledges its responsibility for violations with respect to the Ontario Water Resources Act and directs the City Solicitor to facilitate and enter pleas of guilty to the two charges on September 11, 2008 and to make submissions as to sentencing as soon as possible thereafter; and

 

2.         Council directs the City Manager to create the new position of Environmental Compliance Officer within the Water and Waste Water Services Branch reporting directly to the Director of Water and Waste Water Services on all regulatory compliance issues relating to the provision of drinking water and wastewater services and that beginning in 2009, for the 2008 operating year, and every year thereafter, the Director of Water and Waste Water Services be directed to provide an annual report to Committee and Council on regulatory compliance issues in the water and wastewater services area; and

 

3.         In recognition of the important work by The Friends of Petrie Island and the Ottawa Riverkeeper, being local organizations that share Council’s objectives of protecting and enhancing the Ottawa River, and in recognition that it is important that investments in the environment be made at the community level and benefit the local environment, Council directs that contributions in the amount of $50,000 to each of these organizations be made as soon as possible to be funded from the Public Works & Services Department.

WHEREAS City Council on 28 May 2008 directed the Auditor General to conduct a full review of all of the facts and issues related to the summer 2006 wastewater spillage and report back to City Council on findings and recommendations no later than September 2008;

 

AND WHEREAS the Auditor General is continuing his investigation;

 

THEREFORE BE IT RESOLVED THAT the Auditor General be directed to bring forward the report to the Council meeting of 22 October 2008.

THEREFORE BE IT RESOLVED that the Deputy City Manager of Public Works review the Strandherd and Woodroffe Road widening projects with a goal of identifying lessons learned and any matters related to performance and report back to the Ward Councillors before the end of 2008.

WHEREAS the costs of managing and operating a municipality are based on a different basket of goods and services than those used to calculate the Consumer Price Index, i.e.  most households normally do not buy asphalt, cement, salt, diesel fuel, etc. or maintain thousands of kilometres of roads, pipes and wires, and

 

WHEREAS understanding the cost structure of the inputs required to operate a municipality is essential to better governance, and

 

WHEREAS there is no generally accepted municipal price index available to municipal planners and legislators

 

BE IT RESOLVED that the Federation of Canadian Municipalities be requested to develop an MPI for use by all municipalities based on their Quality of Life Indicators research.
