BACKGROUND
The subject property is located at 6 Antares
Drive which is part of the Hunt Club West Business Park and is located west of
West Hunt Club Road, one intersection north of the West Hunt Club Road and
Prince of Wales Drive intersection. The subject property is
approximately 0.7 hectares in size. The
site is bounded to the south by Antares Drive, to the north and east by
commercial office buildings and to the west by an industrial use building.
There is a commercial office building on site,
which is surrounded on three sides by surface grade parking. A two-car garage
bay is located along the building's west facing wall.
A manual car wash and automobile detailing
business has been operating for approximately four years as a non-conforming
use at this location. The operation has
been carried out in the garage bay located within the existing building.
The applicant is proposing an exception to the existing zoning of this property in order to legalize the manual car wash and detailing business, which would be limited in gross floor area to prevent expansion
The site is zoned IG5 (General Industrial
Zone, Subzone 5) in Zoning By-law 2008-250.
A mix of light industrial uses are permitted in this zone, including
automobile body shop, automobile rental establishment and automobile service
station. Car wash, which includes a
manual car washing and detailing facility, is not a permitted use in this zone.
The site is zoned MP (Industrial Park Zone) in the former City of Nepean Zoning By‑law 100‑2000. The permitted uses in the MP zone are similar to those listed in the IG5 zone and allow a mix of light industrial uses, including automobile service and sales uses. A manual car wash, which falls under the automobile repair garage – minor use, is not permitted in this zone.
Due to outstanding appeals to Zoning By-law 2008-250 that affect the zoning of the subject property, Zoning By-law 2008-250 and Zoning By-law 100-2000 are both in effect and must both be considered for amendment.
DISCUSSION
The Official Plan designates the subject property as Employment Area. Lands within the Employment Area designation are to be reserved primarily for places of business and economic activity such as office space, manufacturing, warehousing, distribution, research and development facilities and utilities. Also permitted in the Employment Area are uses complimentary to the business and economic uses listed above, including commercial services that will serve employees of Employment Areas, the general public in the immediate vicinity, and passing traffic. The proposed Zoning By-law amendment will allow an additional use that satisfies these policies of the Official Plan, as the proposal is requesting to have a manual car wash and automobile detailing operation as a permitted use at this site which will provide a complementary service that will benefit the area employees, and to a lesser degree, the general public.
The property is currently zoned General Industrial, Subzone 5 (IG5) in Zoning By-law 2008-250 and Industrial Park Zone (MP) in the former City of Nepean Zoning By-law 100-2000.
The manual car wash and detailing business has been operating as a non-conforming use for approximately four years at this location, and no issues of compatibility have arisen during that period. The business has been operating on a small-scale, and mainly drawing its clientele from the tenants within the building and from adjacent buildings, with a small share of business coming from the general public within the area. The intention of the Zoning By-law amendment is to allow the operation to be carried out in the same manner and at the same scale as it has been operating over the past four years. Permitting a manual car wash at this location is in keeping with the Official Plan policies as the operation serves as a complementary and compatible commercial service in the Employment Area designation. Staff recommend approval of this application.
CONSULTATION
Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation. The City did not receive any negative comments or opposition to this application.
