Que le Comité de l’agriculture et des questions rurales recommande au Conseil d’approuver une modification au Règlement de zonage 2008-250 afin de changer la désignation de zonage du 5396, chemin Fernbank de Zone agricole, sous-zone 1 (AG1), à Zone agricole, sous-zone 5 (AG5), comme il est indiqué dans le document 1.

 

 

BACKGROUND

 

The subject parcel is located on the south side of Fernbank Road, west of Eagleson Road. The parcel comprises vacant farmland known as 5396 Fernbank Road. The Committee of Adjustment has granted severance of the two existing dwellings on a 0.81-hectare parcel, known as 5390 Fernbank Road. One of the existing dwellings is to be removed.

 

One of the conditions of the severance is that the vacant farmlands, a parcel 35.6 hectares in area, be rezoned to prohibit the construction of future dwellings on the land.

 

The purpose of the zoning amendment is to fulfil the rezoning condition imposed by the Committee of Adjustment.  The existing zoning on the parcel is Agricultural Subzone 1 (AG1).

 

DISCUSSION

 

The parcel is designated “Agricultural Resource Area” in the Official Plan.

 

The policies permit severance of dwelling made surplus through farm consolidation provided the vacant agricultural parcel is rezoned to prohibit any residential use. The proposed rezoning therefore implements the intent of the Official Plan.

 

The proposed zoning will place the vacant farmlands in an Agricultural Subzone 5 (AG5) to prohibit future residential uses thereon.  The zone will set a minimum lot area of 30 hectares and a minimum lot width of 60 metres.

 

RURAL IMPLICATIONS

 

The rezoning protects and preserves the agricultural use of the retained vacant farm parcel by prohibiting future dwellings from being constructed thereon.

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy.  The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.

 

LEGAL/RISK MANAGEMENT IMPLICATIONS

 

There are no legal/risk management implications associated with this report.  Approval of the recommendation will implement one of the standard conditions set by the Committee of Adjustment for a farmland severance.
