BACKGROUND

 

On June 25, 2008 City Council adopted the new Comprehensive Zoning By-law 2008-250 that affects all properties within Ottawa. By-law 2008-250 replaces the 36 Zoning By-laws of the former municipalities that were amalgamated in 2001.  Since the adoption of the Zoning By-law, staff have been identifying anomalies that require correction, and reports to correct the anomalies are being forwarded to Committee and Council on a regular basis.

 

 

DISCUSSION

 

Since the adoption of the Zoning By-law 2008-250, staff have monitored the new by-law and identified certain anomalies that are being recommended for correction.  This report corrects an identified anomaly in the rural area of the city.  Document 1 provides details of the relevant anomaly and proposed remedy.  Document 2 is a map showing the location of the property and the proposed zoning change.

 

Such anomaly amendments are intended to correct mapping and text reference errors in the implementation of Council-approved changes that are not accurately reflected in the Comprehensive Zoning By-law.

 

This item is coming before the Committee as a single item in order to accommodate issuance of a building permit for the spring construction season.

There are no rural implications arising from this report.

Notice of the public meeting to deal with these anomalies and corrections was provided in The Citizen and Le Droit, with a listing of the addresses and provisions subject to correction. As well, interested parties have been notified by individual mail.

201 Cyd Street

This property is zoned Rural Residential - RR2[13r].  Exception [13r] permits a minimum lot area of 6,000 square metres.  The RR2 zone requires a minimum lot width of 50 metres.

 

201 Cyd Street is a pie-shaped, vacant lot.  At the time the subdivision was approved, in 2004, it was subject to the provisions of the former West Carleton By-law 266 of 1981 and designated Country Lot Residential - RCL-52.  The RCL zone states that lot widths are as shown on registered plan of subdivision.

 

The plan of subdivision for this property was registered on July 19, 2004, as Plan 4M-1239. 

 

Using the dimensions shown on Plan 4M-1239, under By-law 2008-250, this property has a lot width of 29.74 metres and a lot area of 7542 m2.

 

Given that there is no land use established on the lot and that its width was deemed legal for the RCL-52 zone at the time of creation, a new exception needs to be created to recognize the legal lot width, which is less than that required under the RR2[13r] zone.

Amend the Zoning Map to rezone 201 Cyd Street from RR2[13r] to RR2[xxxr], as shown in Document 2.

 

Amend Section 240 to add a new Exception, [xxxr]. Column V of Exception [xxxr] to read:

 

-          minimum lot width of 25 metres;

-          minimum lot area of 6,000 square metres
