received from residents of Cathcart Street, containing 39 signatures, requesting that the City of
Ottawa change the parking regulations on Cathcart Street. The petitioners are
requesting that the existing 3 hour parking on the North side of Cathcart
Street between King Edward and Rose Streets be replaced by 1 hour parking
between 7 a.m. and 7 p.m. from Monday to Friday, and that parking be prohibited
on the South side of Cathcart Street between King Edward and Rose Streets.
Changes are being requested for safety reasons and to prevent the use of the
street as a parking lot for external affairs.

of Zone C2 Solid Waste Curbside Collection and Services Contract No.
01811-91027-T01 to Miller Waste Systems Inc. (Markham, ON) for first year total
cost of $5,998,030 (HST not included), subject to annual CPI and growth
increases as determined by the contract;
3. That
Form of Tender, Basis of award Section 16.3 of the SOLID WASTE CURBSIDE
COLLECTION AND SERVICES tender (RFT #01811-91027-T01) be exercised and award of

01811-91027-T01 to the second lowest bidder, Miller Waste Systems Inc.
(Markham, ON), for first year total costs of $5,548,628 (HST not included),

of Zone C5 Solid Waste Curbside Collection and Services Contract No.
01811-91027-T01 to the City Of Ottawa In-House Group (City of Ottawa, ON) for
first year total cost of $5,807,713, which includes the establishment of an
additional 39 positions (temporary for the term of contract), subject to annual
CPI and growth increases as determined in the contract;
5. Establishment
of the annual budget for the
City of Ottawa In-House Group, which was awarded the Curbside Collection Zone
C3 at the August 25, 2011 Council meeting, based on all terms, conditions and
assumptions used to calculate the In-House bids for other zones for the Solid Waste Curbside Collection and Services
Contract No. 01811-91027-T01, which
results in Zone 3 first year costs of $5,508,731, which includes the establishment
of an additional of 7 positions (temporary for the term of the contract),
subject to annual CPI and growth increases as determined in the contract;
6. An
increase to the 2012 Capital Budget Authority in project 906332 Solid Waste
Fleet Replacement by the amount of $3.5M for a total authority of $3.795M, for
the acquisition of 13 new collection vehicles to be funded from the Solid Waste
Capital Reserve Fund to be repaid by the Fleet Replacement Reserve Fund,
causing no tax pressure in 2012;
7. Delegation
of authority to General Manager, Public Works to enter into a purchase or lease
agreement, whichever is the most cost efficient, for the Fleet requirements for
Zone 5 vehicles, subject to the City Treasurer review and approval; and
8. Requirement for an annual audit of
expenditures for works awarded to the City and an annual information report,
qualitative and quantitative in nature, relevant to this program and subject to
the normal committee process.

Planning Committee Meeting John Dickie, Chair of the Eastern Ontario Landlord
Organization, requested that multi-residential properties be treated the same
way as condominium properties in the proposed amendment to the Urban Tree
Conservation By-law; and
WHEREAS City staff agrees that
multi-residential properties should be treated the same way as condominium
properties for the same reasons outlined within the staff report;
THEREFORE BE IT RESOLVED that Document 1 of the Two Year Review of the Urban Tree Conservation By-law report be changed to the attached.

Urban Tree Conservation By-law 2009-200
Purpose: To exempt condominium properties and existing multi-residential developments from the provisions of Part II of the UTCB and to instead apply the provisions of Part III.
Method:
1. Add the following to Section 4, “SCOPE”, of Part II;

4A. Despite Section 4, the provisions of this Part shall not apply
to condominiums or existing
multi-residential developments on properties greater than one hectare.
2. Change the wording of Section 14, “SCOPE”, of Part III as follows;

SCOPE
14. This Part applies to distinctive trees on properties one hectare or less in area and on condominium properties and existing multi-residential properties greater than one hectare in area within the urban area of the City.
3. Add a definition of “condominium” and of “multi-residential development” to Part I under DEFINITIONS as follows;
“condominium” means a corporation created upon registration of a declaration and description under the provisions of the Condominium Act, 1998.
“multi-residential development” means land used for residential purposes that has seven or more self contained units under single ownership.

Pursuant to Subsection 13 (1)(d) and (f) of Procedure By-law 2006-462, this item was to be dealt with In Camera. However, Council approved the confidential direction to staff contained in Transit Commission Report 9 on consent, in open session. Pursuant to direction of Council provided at Motion 89/4 on 12 May 2010, this report cannot be reported out for the following reasons:
The subject matter of this report centres around consideration of labour relations and negotiations with the ATU Local 1760, the unit comprised of OC Transpo’s clerical, professional and support employees. More specifically, it relates to directing staff regarding bargaining for the renewal of the collective agreement which expires on December 31, 2011.
In accordance with the provisions of Subsection 239(2)(d) of the Municipal Act, 2001, as well as Subsection 13(6) of the Procedure By-law, the subject matter of this report deals with “labour relations and employee negotiations.” Therefore, the report may be received and considered by the Transit Commission and City Council, and direction given to staff, in closed session.
As the disclosure of the City’s collective bargaining strategies and mandates for this union would likely impact on negotiations with the City’s remaining unions, making this report public may detrimentally affect the City’s overall labour relations interests. As such, this report will not be made public.
