During its meeting on March 25, 2020, City Council considered a motion regarding Declaration of Vacant Office on Council - Ward 19 (Cumberland) and Related Matters. Council declared the Office of Councillor, Ward 19 (Cumberland) to be vacant, as mandated by the Municipal Act, 2001, and approved interim delegated authority for certain matters as required.
Since the Novel Coronavirus (COVID-19) pandemic continues to evolve and is causing significant, ongoing and shifting effects throughout the City of Ottawa, Council did not consider the options of a by-election or appointment at that time.
On April 22, 2020 City Council received the report titled “Ward 19 (Cumberland) – Vacancy Options”. Council approved a motion to defer the decision on how to fill the vacancy in Ward 19 (Cumberland), whether to appoint or enact a by-election by-law under Section 263 of the Municipal Act, 2001, until more information is available regarding the end of the emergency.
On July 15, 2020 City Council considered a report titled "Ward 19 (Cumberland) - Vacancy Options (July 15)". Council approved the report recommendations to:
- hold a by-election to fill the vacancy in the Office of Councillor, Ward 19 (Cumberland) in accordance with the Municipal Elections Act, 1996; and
- to permit the use of a special mail-in ballot that does not require electors to attend at a voting place in order to vote in accordance with Subsection 42(1)(b) of the Municipal Election Act, 1996, for the Ward 19 (Cumberland) by-election.
