The MMAH added lands to the city’s urban boundary upon approval of the new Official Plan on November 4, 2022. Some of the lands added by the MMAH are not yet covered by the Tree Protection By-law 2020-340.
Council provided staff with the following direction:
Direct staff to submit to Council by-laws in respect of the Tree Protection and Site Alteration By-laws to apply the relevant provisions of each by-law to protect trees and natural features on any land areas evaluated in Document 2 or 3, and the lands within Riverside South shown on attachment 1[2] to this motion until such time subsequent to Ministerial approval of the new Official Plan, Council considers a report on the appropriate geographical limits of each by-law in accordance with the Minister’s decision.

First, it creates a new policy that more precisely outlines conditions for how certain matters of the Official Plan may be removed or modified. This re-locates and logically restructures the second half of 12.1, Policy 7) into a more appropriate subsection.
Second, this proposes to modify policy intent by adding precision that the Evolving Neighbourhood Overlay may be modified through a Secondary Planning process. As currently written in 12.1, 7), the Evolving Neighbourhood Overlay may only be modified through a comprehensive review of the Official Plan. Secondary plans intend to provide specific direction for the development of a neighbourhood or area after a detailed and thorough lot-by-lot analysis. Preventing this overlay from being modified through this process limits potential growth opportunities, such as uniquely large sites designated as Neighbourhood that weren’t originally within the maximum distances outlined in section 5.6.1.
