In May 2017, the Ontario Lottery and Gaming Corporation (OLG) announced that Hard Rock Casino Ottawa was selected as the service provider for the Ottawa area gaming entertainment centre, to be located at the Rideau Carleton Raceway, at 4837 Albion Road. In September 2017, City Council confirmed the Rideau Carleton Raceway as a gaming site and submitted a summary of the process, public input received, and Council’s resolution to the OLG. Hard Rock Ottawa has taken over the ongoing operations of the Rideau Carleton Raceway and plans to open 35 previously-approved gaming tables within the existing facility in early 2018.
On February 2, 2018, the City of Ottawa received a zoning by-law amendment application from Novatech Engineers, Planners and Landscape Architects on behalf of Rideau Carleton Raceway Holdings Limited.
The zoning by-law amendment is required to permit a nine-storey hotel, a theatre and to increase the permitted number of gaming tables associated with a casino use from 35 to 55.

City planning approvals
Before the development can proceed, the applicant needs several planning approvals from the City of Ottawa, including a Zoning By-law Amendment and a Site Plan Control application. The applicant has not yet submitted the application for Site Plan Control.
Who will approve the applications?
City Council will make the final decision on the Zoning By-Law amendment application. City staff will make their recommendation to Agricultural and Rural Affairs Committee (ARAC) and Council in the spring 2018. Should Council approve the proposed amendments, it will pass by-laws and a 20-day appeal period will follow.
Staff have delegated authority to approve the site plan control application.
Can the application decisions be appealed?
By providing comments on the Zoning By-law amendments a decision is made by City Council, you have the right to appeal Council’s decision to the Local Planning Appeal Tribunal. Comments must be submitted in writing to the file lead or in writing or orally to ARAC to preserve your appeal rights. Appeals must be filed within 20 days of the date of Council’s written decision and include the reasons for the appeal and the fee. Only the property owner can appeal the staff decision on the site plan control application.

Next steps in the development application approval process
- You may comment on the proposed zoning by-law amendment.
- City staff will review all public and technical comments.
- All public feedback will be summarized in an As We Heard It report after the 28-day circulation period.
- City staff will provide both public and technical feedback to the applicant for their response.
- Planning staff will prepare a report and provide a recommendation to the Agriculture and Rural Affairs Committee (ARAC) and Council about the development proposal. City staff will include all comments received from the public in the staff report.

Details about the proposed development application
The Rideau Carleton Raceway and Slots, now Hard Rock Ottawa, is located at 4837 Albion Road. The lot is about 84 hectares (approximately 209 acres) with 542 metres of frontage on Albion Road. The applicant intends to divide the subject property into two separate parcels of land. The severed lands, approximately 40.5 hectares (100 acres), would establish separate ownership for the casino, racetrack and parking areas. The remaining lands, 43.8 hectares (103 acres), would include the existing stables and accessory structure located east of the horseracing track.

Current land use designation and zoning
- The property is designated General Rural Area and Significant Wetlands on Schedule A of the City of Ottawa Official Plan.
- The Official Plan, Section 3.6.7, also recognizes the site as a Major Urban Facility by a site-specific policy. Policy 4 of Section 3.6.7 states:
Notwithstanding the above policies requiring Major Urban Facilities to locate in the urban area, in order to recognize the Rideau Carleton Raceway and Slots facility, located on lands legally described as part of the South Half of Lot 24, Concession 4, Rideau Front, Gloucester, being Parts 5 and 11 on Plan 4R-15731; Parts of lots 23 and 24, Concession 4, Rideau Front, Gloucester, being Part 2 on Plan 4R-15731; and consolidation of various properties: Part of lot 24, Concession 4, Rideau Front, Gloucester, Being parts 3, 4, 6, and 7 on Plan 4R-15731, an exhibition grounds for the viewing of horse racing, gaming premises as defined in the Gaming Control Act and related uses are also permitted in addition to those uses permitted in the General Rural Area designation, in this location;
- Section 4.8.6 of the Official Plan includes policies related to land use constraints in the vicinity of the Ottawa International Airport. 4837 Albion Road is within the Airport Vicinity Influence Zone as shown on Schedule K of the Official Plan.
- The property is currently zoned Rural Commercial, Subzone 4, Rural Exception 528 with a maximum height of 15 metres (RC4[528r] H(15)), () and Environmental Protection Subzone3 (EP3).
The current RC4 [528r] H(15) zoning permits a casino, as well as a place of assembly, fairground, sports arena limited to a horse racing track, amusement center limited to a bingo hall, restaurant, retail store limited a flea market. The gaming facilities are limited to slot machines and 35 gaming tables. The zoning also states that no new buildings are permitted to be constructed on the site except for the casino use.
The zoning by-law amendment proposed by the applicant is to add hotel and theatre as permitted uses, to increase the permitted height and to permit 55 gaming tables within the existing casino. The requested height is expressed as a geodetic elevation of 151.79 metres above sea level. This generally corresponds to a height of 33.5 metres.
