2018-2022 Municipal Election Compliance Audit Committee

Under the Municipal Elections Act, 1996, candidates, registered third-party advertisers, and contributors are bound by specific election campaign finance rules. Candidates and registered third-party advertisers must file provincially prescribed financial statements with the City Clerk outlining their campaign finance activities.

Any eligible elector who believes on reasonable grounds that a candidate or registered third-party advertiser has broken one of the election finance rules set out in the Municipal Elections Act, 1996, may submit an application for a compliance audit.

The applicable deadlines for each candidate are posted with the Financial Statements for the 2018 regular elections for Candidates and for Registered Third Parties, and for the 2019 Rideau-Rockcliffe by-election.

Committee Mandate and Membership

The Municipal Elections Act, 1996 requires that municipalities establish a committee to hear applications for compliance audits of the election campaign finances of candidates and registered third-party advertisers. 

The 2018-2022 Municipal Election Compliance Audit Committee will:

  • Consider applications for compliance audit of the campaign finances of a candidate for municipal council or a registered third-party advertiser resulting from the regular municipal election or any by-election held during the term of office for the Council for which the Committee was appointed;
  • Appoint an auditor, if the Committee decides to grant a compliance audit;
  • Review the auditor’s report and if the report concludes that the candidate or registered third-party advertiser appears to have contravened the Municipal Elections Act, 1996, decide whether legal proceedings should be commenced against the candidate or registered third-party advertiser; and
  • Receive and consider report(s) from the City Clerk identifying contributors who appear to have contravened any of the contribution limits set out in the Municipal Elections Act, 1996, and decide whether to commence a legal proceeding against a contributor for an apparent contravention.

How to Submit an Application for a Compliance Audit

Any eligible elector who believes on reasonable grounds that a candidate has broken one of the election finance rules set out in the Municipal Elections Act, 1996, may submit an application for a compliance audit.

An eligible elector is:

  • a resident of the City of Ottawa, or an owner or tenant of land in the City of Ottawa, or the spouse of such an owner or tenant;
  • a Canadian citizen;
  • at least 18 years old; and
  • not prohibited from voting by law.

All requests for a compliance audit must be made on the appropriate form provided below. Incomplete applications will be returned to the applicant. A separate compliance audit application must be submitted for each individual candidate. All complete applications for a compliance audit will be forwarded to the Committee. There is no fee for submitting an application.

Deadline for submitting an application

There are two periods for compliance audit requests: the preliminary financial filing period and the supplementary financial filing period. Applications for a compliance audit must be made within 90 days of their filing, and must be made by 4 pm on any regular business day:

With respect to the 2018 regular election:

  • Applications for a compliance audit on a preliminary financial filing can be made after 2 pm on Friday, March 29, 2019 until 4 pm on Thursday, June 27, 2019.
  • Applications for a compliance audit on a supplementary financial filing can be made after 2 pm on Friday, September 27, 2019 until 4 pm on Friday, December 27, 2019.

With respect to the Ward 13 By-election:

  • Applications for a compliance audit on a preliminary financial filing can be made after 2 pm on Tuesday, July 2, 2019 until 4 pm on Monday, September 30, 2019.
  • Applications for a compliance audit on a supplementary financial filing can be made after 2 pm on Thursday, January 2, 2020 until 4 pm on Wednesday, April 1, 2020.

Applicants will be notified of the Committee’s meetings and decisions related to the application.

To submit an application for a compliance audit:

You may print and complete the form. Alternatively, you may enter information into all parts of this form before printing with the exception of the “Declaration” on page 3, which must be signed after printing.

3.  After completing a form (1 or 2), submit the form in person at the Elections Office, or by appointment at the Office of the City Clerk, to ensure that your form is complete.

4.  Please note that the application must be submitted before 4 pm on any regular business day.
