BACKGROUND
What has Happened to Date
The following is a brief history of the Official Plan Amendment for Mahogany Community in the village of Manotick.
• July 17, 2007 – Minto Developments Inc. made an application to amend the Manotick Secondary Plan for the Mahogany Community;
• February 13, 2008 - Council refused the Official Plan Amendment (OPA);
• March 3, 2008 – Minto appealed the Council decision to the Ontario Municipal Board (OMB);
• April 8, 2009 - The OMB allowed the appeal of the Council decision by Minto and approved the OPA for the Mahogany Community;
• April 22, 2009, Council appealed the OMB decision to Divisional Court;
• November 13, 2009 - Divisional Court dismissed the appeal and OPA 81 is now approved.
One of the policies in OPA 81 states "a comprehensive Development Concept Plan as approved by the City of Ottawa will be used as the basis for the approval of subsequent plans of subdivision, site plans and zoning in Mahogany Community".
The Development Concept Plan (DCP) for the Mahogany Community has not been approved. Council did not approve the DCP that was prepared to support the Mahogany OPA when Council refused the OPA. The DCP was not before the OMB for approval.
Next Steps
Future development in the Mahogany Community will proceed by plan of subdivision according to the policies set out in OPA 81. All development applications will go through the development review process, a public process where the community will have the opportunity to review the plans and provide comments.
Development Concept Plan
OPA 81 requires that a DCP will be used as the basis for the approval of subsequent plans of subdivision, site plans and zoning in Mahogany Community. The DCP is comprehensive plan that provides guidance for how OPA 81 policies for the Mahogany Community will be implemented. It provides for the coordination and the integration of streets, parks and open space, pedestrian links, servicing, and stormwater management. The DCP also provides direction regarding environmental protection, phasing of infrastructure and community design guidelines that will form the basis of the design of future plans of subdivision.
The DCP is an important tool that requires subsequent plans of subdivision, site plans and zoning in Mahogany Community to proceed in an integrated and coordinated fashion according to the design guidelines set out in the plan. To have any statutory weight, Council approval is required.
The DCP for Mahogany Community provides guidance for how the policies in OPA 81 that were approved by the OMB will be implemented.
A community meeting was held in Manotick on February 4, 2010 to discuss the next steps in the approval process for the Mahogany Community.

Councillor Brooks reported that he had called a public meeting to discuss the proposal and together with Legal Counsel and the Rural Affairs Officer, made a presentation to approximately 100 residents. Mr. Jack Stirling was also in attendance as a representative of Minto. Councillor Brooks indicated that this item has been a struggle for the community, noting their recent appeal of the Ontario Municipal Board (OMB) decision, which resulted in a split decision at the Division Court level. Acknowledging that it is now time to move forward, he expressed appreciation for the firm commitment from Minto to respect the character of the village and hoped the community and this Committee would support it as well.
Mr. Klaus Beltzner thanked the committee for hearing from the residents of Manotick and supporting them. He also thanked the West Manotick Community Association for all the hard work they have done to move the project forward and to deal with the issues of principal that the community strongly believes in. He thought it was time to move forward but he also wanted to make sure that Manotick was differentiated from the other southern urban communities close by. Mr. Beltzner felt strongly that there is a need to have a coordinating committee that could look at how to deal with some of the confusions and problems associated with this project, including, but not limited to, development applications.
Councillor Hunter expressed disappointment about the time and money that has been spent fighting this plan, which he suggested is one of the most beautiful and exciting plans for a community that he has seen. He appreciated the concerns and frustrations of community residents but was displeased that his Council colleagues had allowed the issue to become so onerous and financially burdensome. He supported the report recommendation as presented.
